NPA wins appeal in Zuma case

2009-01-12 11:19

Bloemfontein - The Supreme Court of Appeal on Monday upheld an appeal by the National Director of Public Prosecutions against a high court ruling that halted the prosecution of ANC leader Jacob Zuma.

This means that Zuma, the front-runner for the presidency in the upcoming elections, will still have to face corruption charges.

AMA ZING!!!!

ZOLA 1/12/2009 11:23:51 AM
Thank you Jesus!!!

Greg 1/12/2009 11:24:34 AM
I'm not saying he;s guilty or not, but I think it's a good thing. This matter needs to get sorted out in the courts.

Justin 1/12/2009 11:26:50 AM
I'm really not surprised that this result has come about. It's a fair result. The man is forever stating that the law must run it's course, he now has his opportunity to prove his highly doubtful "innocence". I'd like to see if his leftist comrades stand by him now, seeing as they've already gotten their way ...

JL 1/12/2009 11:28:20 AM
Yes, All of South Africa needs closure on this issue... Let the law take its course and lets see how corruption has infested the top order of our country's leaders. If guilty he needs to be prosecuted and go and have a chat with his old mate mister Shabir!

Sebata 1/12/2009 11:28:28 AM
Hallelujah! I have regained my faith in this country. Mr Zuma - i about time you dance to your tunes.

MUSASHI 1/12/2009 11:28:42 AM
Anyone with a little legal knowledge could see this coming!Wonder how Mr Zuma will next use our tax money to have his legal team try and prevent him ever going to trial and facing the charges against him. I am sure he knows if he ever goes to trial he will share a cell with Shaik....

Dries 1/12/2009 11:29:54 AM
This is a blow for "counter honesty", "counter accountability" and "counter corruption charges"! Me thinks we will hear Blair and Bush and Mata Hari and Isreal and carbon emmiting counter revolutionary countries are behind all this

Lubbe 1/12/2009 11:29:58 AM
He did not pay the right people enough this time round !!!

Justice 1/12/2009 11:30:42 AM
Great....let him have his day in court.

Thami 1/12/2009 11:30:46 AM
to be expected that SCA would rule against Zuma. Judge Nicholson I believe did not overstep his authority. It is a matter of SCA taking sides with NPA i.e. the judgement is made with political inuendos. Ask the SCA "gangs" who is their papa and they will tell you exactly what ANC has been saying all along. The judiciary needs to be revitalised asap! VIVA ANC VIVA! VIVA JZ VIVA! I stand by the NEC decision to ask Mbeki to step down, common sense should prevail!

jackey 1/12/2009 11:31:06 AM
NOW CHARGE THE BUGGER, AREEST AND LOCK HIM UP AND THROW AWAY THE KEYS..

Treasure 1/12/2009 11:31:21 AM
What difference does it make. Zuma will still be the president of the country whether you like it or not.

Blacklisted Hardliner 1/12/2009 11:31:30 AM
Mr Zuma, the honorable thing to do is to submt yourself and get your day in court as you have requested sometimes ago.

Y 1/12/2009 11:31:36 AM
So some parts of our judicial service still function....

Pieter 1/12/2009 11:31:51 AM
This is the best news I've had in about a Year of gloomy news. Fantastic, may the Justice system prevail and may Zuma truly get his day in court without these political technicallities. May the guilty be found guilty!

Matt 1/12/2009 11:31:53 AM
Fantastic! No one is above the LAW! NO ONE! If he is innocent let it be so, if not then jsutice has been done! We MUST uphold our countries LAW!

Come On News24! 1/12/2009 11:32:02 AM
IOL and MG have an in-depth SAPA story - you have two lines? Pathetic.

Sebata 1/12/2009 11:32:21 AM
Hallelujah! I have regained my faith in this country. Mr Zuma - i about time you dance to your tunes.

Boni 1/12/2009 11:32:33 AM
Nicholson really overstepped the boundaries. This questions his integrity especially given the utterances by some Zuma supporter days before his judgement. Seems like he was bribed or something. Ruling on something that is not before the court is a NO NO. and why the Zuma team didnt see that, is beyond me. but i guess another appeal is on the cards.

shanmoff 1/12/2009 11:32:38 AM
During the entire Zuma saga - the ANC has tried various avenues to stop his prosecution, while at the same time saying they respect the rule of law, and Zuma should have his day in court. Wonder what the next delay tactic is that is sitting up their collective sleves?

vts 1/12/2009 11:32:57 AM
zuma must step down as candidate for presindency of ANC and face the charges .

MUSASHI 1/12/2009 11:32:57 AM
If the ANC used Nicholson's judgement to fire Mbeki, then certainly he should be re-appointed in view of the Appeal Court's finding???

Benzo 1/12/2009 11:33:01 AM
Just wondering what his legal team has up their sleeves this time. Any postponement will keep the revenue going. A court case and the outcome thereof, negative or positive, will stop this lucrative source of revenue. They might hope for negative with some appeal options. They might create some trials within a trial to keep the money coming. And...who is paying the bills??

Zolile 1/12/2009 11:33:24 AM
Good point Justin, I did not think that way but it makes sense. The commies have had their way, will they dump him now? Again, what of the mistakes like recalling Mbeki based on wrong conclusions? Interesting times ahead, what a way to start 2009!

solrakkant 1/12/2009 11:33:29 AM
well, well, well we will see now. Asked for your day in court and you shall receive! Let the law run it's course

Brian 1/12/2009 11:33:41 AM
Let's hope that this can get a speedy verdict, either way. It needs to be over ASAP.

Get Real 1/12/2009 11:34:03 AM
Now this will be part of their fight against corrupcy, sarting with their own president! Let's see them keep this promise!!! Thank you for a independent law system, because I still believe Nicholson was bought! This is a victory for the people!

Big S 1/12/2009 11:34:03 AM
Yebo yes!!! something to smile about at last. It is about time.

Carlo 1/12/2009 11:34:08 AM
Thank goodness justice prevailed. Hopefully this will aid in SA not having a president that will cause embarrassment to a country fighting hard to win the world's respect.

jack 1/12/2009 11:35:31 AM
It does not matter , he will run to every court available using our tax money - thief

Happyness 1/12/2009 11:35:40 AM
Every dog gets his day. And a bulldog gets a weekend. Hopefully we will see justice now.

Andre 1/12/2009 11:35:53 AM
This gives me some hope for the justice system in our country. However, Zuma and his cronies will pull out more than all the stops to try and counter this. Can't wait for the next eloquent piece of wisdom on this ruling from super-sharp Julius!

Stizozo 1/12/2009 11:35:54 AM
I wish Zuma will now let the law take its cause, meaning he will defend his innocens in Coart. But I can't shake the feeling that he will appeal this ruling by the Supreme Coart.

L van Heerden 1/12/2009 11:36:16 AM
This Nicholson fella should get a job in the Zuma campaign. He wasted the taxpayer's money with the most ridiculous ruling possible. He should be kicked out of the justice system. He is disgrace

Annie 1/12/2009 11:36:33 AM
Judge Louis Harmse has certainly (Harm)ed Mr Zuma! I wonder what negotiations will follow beteen the NPA and Mr Zuma ?

Shaz 1/12/2009 11:36:53 AM
ZOLA,Amen is all I can say, I'm so happy about the rulling that I have goose bumps.I was watching the news last night looking at fellow blk people pushing water with wheelbarows going home (shacks) and to think these people vow to support Zuma makes me raging mad. I said to my mom, these very same people chanting "mshini wami" will be no better off come next election and they will still vote for the ANC.Same goes for Zim, they are Dying in droves yet still shout "Mugabe" Go Figure!Fellow Blk

Lady J 1/12/2009 11:36:53 AM
This is a really good thing that has happened now lets see how this will unfold!!

terryt 1/12/2009 11:36:58 AM
A very considered and correct judgement! As an aside it seems to back Pikoli's decisions too and it will be interesting to hear the outcome of his current position.

mootledi lehlokoa 1/12/2009 11:37:01 AM
just what i've been expecting. now zuma's innocence is gonna be proven through a court trial and not through some baseless & unfounded technicalities.

Darren 1/12/2009 11:37:03 AM
Finally. Justice. Zuma out.

Steve 1/12/2009 11:37:11 AM
to wait for ANC, Cosatu and SACP to trash the judiciary... after they praised it with Nicholson ruling. JZ you will have your day in court. VIVA!!!

solrakkant 1/12/2009 11:37:14 AM
well, well, well we will see now. Asked for your day in court and you shall receive! Let the law run it's course

Dorothy 1/12/2009 11:37:34 AM
Yes - we need closure, and Zuma must have his day in court. The real problem is the cost of all this and who pays for it. The cost so far has been enormous - all funded by SA tax payers - NOT Zuma. He will fight this, and we will pay again. Zuma must pay his legal costs himself or get legal aid. The tax payer shoudl only pay if Zuma had done his alleged crime on behalf of South Africa.

Phoebe 1/12/2009 11:38:05 AM
thank you to the custodians of justice in the supreme court.

Thabo 1/12/2009 11:38:08 AM
Is time for JZ to face the prospect of his alleged corruption. I hope Zuma and his bacbkers will accept Harmse' judgement like they did with Nichilson's judgement.

Mpho 1/12/2009 11:38:14 AM
JZ will now at last have his day in court...we congratulate our judiciary on this sober minded decision

Jason 1/12/2009 11:38:18 AM
This was the only fair and logical result.

John Camp 1/12/2009 11:38:32 AM
his day in court, he wanted it, he got it!

Francois 1/12/2009 11:38:56 AM
XMAS CAME EARLY THIS YEAR!

DJ 1/12/2009 11:39:02 AM
Now I'm not saying that he is guilty, and I'm not saying that he is not not-guilty but the facts are: One man is serving a corruption sentence for purchasing preferential treatment from Mr Zuma, while Mr Zuma uses your and my taxes to pay defense to keep him out of court. Is this fair? Is it just?

Mark 1/12/2009 11:39:04 AM
YES YES YES YES YES YES YES YES

Shaba 1/12/2009 11:39:33 AM
Zuma must do the Honourable thing, which he must Go to Court & Clear his name if he feels he?s innocent or the is conspiracy against him. This thing of appeal afta appeal (Yes I know it?s his Constitutional Right to Appeal if he feels that the Judgement has errors). This Thing is Tainting our Constitutional Bodies from Executive to the NPA & also the Courts

Karabo 1/12/2009 11:40:17 AM
He did ask for his day in court and now he will have it, so its time to put the 'trial by the media' aside and let the courts judge.

Tebogo 1/12/2009 11:40:23 AM
Corruption, corrupt president, Not for me...Thanks you

South African 1/12/2009 11:40:39 AM
There is a glimmer of hope for this Country after all! Well done to those not scared to take this man on. Happy 2009 Mr Zuma - may your year continue as it has begun!

Jason 1/12/2009 11:41:46 AM
If Jacob Zuma has any sense of decency he will withdraw from the presidential race. Guilty or not, it will be an international embarrassment if he stands for president.

Brad 1/12/2009 11:42:10 AM
What wonderful news ...this clearly shows that the ANC does not rule the South African Judiciary. This could be the start for great change in our country.

Johan Swarts 1/12/2009 11:42:13 AM
I agree with Justin - if he's innocent, now is his chance to finally prove it. If he's guilty, he can be duly charged. Eitherway its good for South Africa, who (probably) either gets an innocent new president or avoid a criminal to become one. Great stuff.

GeePmb 1/12/2009 11:42:29 AM
... to JZ. Stop trying to delay your corruption trial. FAce the courts and prove that you are innocent. Only when proved innocent, will you have the credibility to be the President of South Africa. You want to stamp out cprruption as per yur manifesto, then prove to us that you are not guilty and don't use technicalities to delay your case.

Africanson 1/12/2009 11:43:00 AM
Altough i had expected this outcome, i am left to wonder than i thought.I think to avoid many things, JZ should bravely step down as the ANC elections frontrunner for President of the country. I hope and pray that Malema will agree with me on this one.

Christopher 1/12/2009 11:43:22 AM
It is a good thing, but how long will the matter be dragged out now. If Zuma and the ANC really has South Africa's best interest at heart, then they must do the right thing and have Zuma withdraw from the elections.

Happy! 1/12/2009 11:43:22 AM
Hoo-bloody-RAY! Strange how a public figure, claiming to only want his day in court, spends so much time and (taxpayers) money to avoid that same court.

Christopher 1/12/2009 11:43:22 AM

SA politics? never a dull moment?

Godfrey 1/12/2009 11:43:43 AM
Now for Mr.Zuma's day in court. Hopefully he and his supporters accept this judgment with the same level of excitement as the Nicholson judgment.

Janette 1/12/2009 11:43:54 AM
All fair in what, will be interesting to see how this pans out..... I doubt if it will be an honest outcome, Zuma will once again cost the Tax payer money and his supporters will once again take unnecessary time off to be there, instead of working in this time of recession.

Filemon 1/12/2009 11:43:58 AM
and waste more taxpayers money that could have been used to fulfill the empty manifesto promises? Or seek the "political solution" which proves his guilt? He cannot afford to lose his job because he will have another wife and kids soon and have to pay even more maintenance. Sprinklerhead say sorry - it is your last chance

oj 1/12/2009 11:44:05 AM
this is a real bad day for our country and revolution, for one of our struggle heroes and stalwards can be persecuted like this! The sacrifices he made and the wars he fought are all forgotten by the same people all his sacrifices were for-how easy we forget!

Mike F 1/12/2009 11:44:21 AM
Judge Nicholson's opinion in 2008 that there was political interference in the decision to prosecute Jacob Zuma was very irresponsible. The ANC swooped on this opinion like vultures to recall President Thabo Mbeki on the basis of this opinion. The ANC was very vocal then. Now Carl Niehaus is calling for restraint from the media. The ANC must stop assessing the judiciary according to how judgements go for or against Jacob Zuma. Assess the judgements for accurate content.

Simon Sez 1/12/2009 11:44:25 AM
HALLLLEEEELLUUUJAAAHHH!!! I hope he gets nailed. 1 down and so many more to go. Take every corrupt politician and get them out of positions of power that they continually abuse, at the expense of us poor tax payers!! This is the best news since petrol came down!

The high court has once again demonstrated that no individual is above the law. Its high time Mr Zuma, has his day in court, and let the courts decide if he is guilty or not, as this cloud over our (South Africa) has to come to an end.

Although this judgement clears his name...the poor man got humiliated. What are the chances of him making a strong comeback?? With COPE maybe...?? Interesting times...and all the Ministers that resigned because the cabinet was accused of interfering with the case??

Promise 1/12/2009 11:46:30 AM
Good :) if you say you are a fair man Mr. Zuma then let the court decide if you are guilty or not...

Fats 1/12/2009 11:46:31 AM
I have NEVER before heard of an innocent man fighting so hard to keep his case out of court. How can such a paragon of virtue who preaches morality and virtue, be accused of having a "genarally corupt" relationship with Schabir Shaik, even though Schaik was found guilty of having such a relationship - poor Mr Zuma must have been completely unaware of this reltionship someone was having with him! How thick are we South Africans?

Dawie 1/12/2009 11:46:56 AM
I hope the ANC will let the court now decide on his fate and not try to influence it. Then all the dust can settle and I still believe he is not fit to lead the country too much controvercy

Truth And Justice 1/12/2009 11:47:22 AM
This bit of news has made Monday the best day of the week for this week...hahaha

Let him have his days / weeks in court so that we can know if he is guilty or not. If he is innocent, why try and stop the process all the time?

South African10001 1/12/2009 11:47:45 AM
Excellent let him prove his innocence or Guilt.....the latter being more likely

Enoch 1/12/2009 11:48:26 AM
SA needs to get to the bottom of this whole corruption thing around the arms deal and other issues. Mr Zuma promised toi get tough on corruption in his manifesto speech, now lets see if he means it. Motlanthe must allow the re-opening of the arms deal probe, "fire" the "travelgate" minions, prosecute Jackie Selebi, and lets have a government that means what it says. Viva, the legal system, Viva!

Lindi 1/12/2009 11:48:52 AM
It is so sad that in these times when a person tries to fight for his freeedom and dignity he is still subjected to insults. The ruling did not come as a suprise to me and it only proved that justice is not as just as it should be and that th ANC were right in saying that the jusice system is manipulated. how do you explain judges contradicting each other?

Funu 1/12/2009 11:48:59 AM
Lets get ready to hear the diatribe coming from the infamous 3 (Blade, Zweli and Ju-ju). They will be back to dust off their judiciary attacks antics. Mudslinging games, that's gonna be the order of the day. Back to raping the judiciary through intimidation. Holler!!!!!!

sessio 1/12/2009 11:49:34 AM
so does this mean Judge Nicholson doesnt know his story? i had my trust torn in shreds your Honour!!!!!!!

Simon 1/12/2009 11:49:38 AM
No one is above the law so Mr Zuma must have his day in court no more threats from the left

JZ 1/12/2009 11:49:51 AM
I would like to see JZ's killer dancing moves again.

Maggie 1/12/2009 11:49:56 AM
JZ the bones failed you this time, and our prayers to God has been answered for the LAW TO TAKE ITS COURSE. If at the end you are found not guilty it is ok but tell Malema that as he goes on supporting you we will also go on praying for a good ruling party for our country.

Sidwell Mahlo 1/12/2009 11:50:13 AM
This is a big blow for the ANC.JZ must go to court and prove herself.

Robert 1/12/2009 11:50:14 AM

dave 1/12/2009 11:51:22 AM
At least the courts have kept their independence, not swaying to the tunes of the political majority. Guilty or not, this was a good decision. Hopefully, Malema does not proceed to "kill for zuma"...

Basholo 1/12/2009 11:51:25 AM
but who will be next in line is the question - actualy irrelevant because he will be a next Bob!

cde 1/12/2009 11:51:45 AM
Justice has taken it course, from here onwards the president of the ANC will now have time to focus on the elections. I am not shaken about the judgement but relieved that this phase is over. AFTER we vote him in as the President of the country that we can look at the judgement, for now we as the ANC are looking forward to the elections. In my opinion the judgement was not clear and the judge only gave brief interpretation of the law and based the judgement on ed cum sections of the constitution

mlungisi 1/12/2009 11:51:50 AM
I've heard only one aspect of the ruling which on political meddling. Can any law expect help us out here?

Counterrevolutionary 1/12/2009 11:52:45 AM

Ja........Mr zuma has forever stating the law must its course and now it is his chance to clear himself of the charges, innocent until proven guilty have your day in court, SIR.You will do yourself and people of this a favour.

JC 1/12/2009 11:57:10 AM
No democracy can function without there being closure on such a critical matter relating to the President of the leading party. Now lets hope for a fair trail.

Wijnand 1/12/2009 11:57:59 AM
What's the bet that all Zuma supporters will shout "injustice" and that they will try and pull another "legal stunt" to save their king? Failing that, they will resort to violence.... Any bets?

Elated one 1/12/2009 11:59:02 AM
Finally justice has been served, everydog has it's day. Now that the appeal has been upheld does that mean that Mbeki will receive an apology from the hooligans who so shamedly disgraced him or are they going to lick their an wounds in shame.Where is Malema i am interested in what he has to say tonight in defence of his master.

TG 1/12/2009 11:59:25 AM
we shouldnt close the case on personal issues.let the law take its course if need be.

Nda 1/12/2009 12:00:12 PM
It's about time to listen to Mshini wam... Beyond attaining the independence from apartheid that this country sought, the ONLY valid mshini wam ever since is the rule and order of LAW. Aw' uleth' umshini wam in the courts at ANY time, and I have no qualms whatsoever with JZ singing to THAT tune. Just lamenting the wasted time, money and the wasted potential in the ANC. Eish!

Humbulani Brian Mashamba 1/12/2009 12:00:19 PM
I cant wait to see what the Monthlathes and the Malemas would say about this. I think they are going to criticize the Judge since well it appears that the judgement did nt go to their favour. Why does not he want to go to COURT
