Fred van der Vyver has finally been found not guilty. Most of us could gather as much from having followed the trial thanks to News24's coverage of the event. But now what?

That means that Inge Lotz's killer is still at large. This, coupled with the fact that the crime scene appears to have been processed with a view that they needed to pin it on Fred, means that the chances of catching the killer have long passed and we are left with yet another cold case.

The point of this article is to look at the toll this trial has taken on a family and a bright young man who has had to endure hell on earth for a long time. Imagine if you will, loving someone and having them viciously ripped from this world, only to suddenly have to deal with being accused of the savage act.

His parents retained the best legal counsel this country has to offer, flew in countless international legal and forensic experts - all with the aim of proving their son was innocent. This cost alone must have run into the millions as senior council and experts come at a premium. Never mind the intense emotional toll something of this magnitude would take on one and their health.

What we know now

So now that we know that the police officer who testified about the elusive finger print from the DVD box/drinking glass lied about its origins, what recourse does the family have against him? Are we so blind as a nation that the way to solve crime is to lie just to get the result; so it looks like we have done our jobs and made the world safer?

That to me is disgusting, and after ignoring the fact that he could not have possibly managed to elude Old Mutual's sophisticated security system, they went ahead and charged him none the less.

This case has been a pinnacle in the media of late, headlines screaming each time it was delayed or resumed; closing arguments heard; then re-opened for Fred to take the stand; then closed again. This all at a great personal cost as well as financial loss to a family.

This young man will be forever tainted after this, all articles indicate he had to leave his job in order to pursue this defence of innocence as well as the fact that he would surely not want to be seen anywhere after making front page for this.

Does this amount to malicious prosecution and if so, what recourse does he and his family have to regain their dignity and financial loss thanks to a bunch of people who, instead of doing their jobs, went after the easiest target and then proceeded to bring his entire life into our homes and minds.

Trial by media

This begs the question of how many people sitting in jail right now - and those awaiting trial - are there that can't afford a legal team like Fred's? How many innocent people have had their lives ripped right from under them only to have to suffer the consequences of others' actions?

Sadly we all know there is an intense pressure from us the public on the police system to successfully prosecute and jail offenders in order for us all to feel that little bit safer.

Why is it though that when a high profile person is involved in a crime then it is solved quickly and efficiently yet every other day things such as blood tests and fingerprints are botched.

Sadly our democracy may say we are all innocent till proven guilty but it is quite the opposite since in order to get to that result you have to pay for the right to be wrongly accused. Lets be honest, legal aid would not have provided this result since there is no room for experts or senior council.

Sadly, while one young man can finally hold his head up and walk free, he will never shake the stigma and the questions. He has to now attempt to rebuild his life; he may not have a criminal record but he sure as hell has a record on the internet and archived news print. Google alone returns 5410 page results for his name world wide when put with the name Inge Lotz.

Do I feel he has been vindicated? Of course I do, but at what cost and who is held responsible for this mistake.

It time that people are made to pay for their actions against other and this includes police who maliciously prosecute all the Fred's in this country.

When a court makes a decision on whether someone is guilty or not, it still does not conclude that they gave the right judgment. Fred is not guilty by law of the court on available evidence, not because Inge came from her grave and pointed a finger. If Fred truly is innocent... then we're all happy for you chap!

a lot of murderers walk free because of technical problems which seems to be te case here as well. The police made MAJOR mistakes and some evidence could not be allowed in court because of this oversight. Furthermore his family could afford the best attorneys/advocates, so he walked free. The wheel turns, once a murderer, always a murderer, he will slip up in future IF IT WAS HIM for SURE!

This boils down to our judical system and and our police are incompetent , If you have the money you can basicly do what you want , but we knew that already , and visa versa you would need money to proof you inocense if you are not guilty otherwise you will becomes som nigerians girl friend in jail for a traffic fine , anything to do with state services is a joke !!

Innocent then I'm glad justice has prevailed. If not it will haunt him for the rest of his life. In SA cases do not go cold, they disappear completeley!

we don't really have police officers who give a damn. Our forensic labs are a mess, our DNA system a mess, so her murderer (if it was not Fred) could be free forever. Check reality tv C & I and you will see for how long police in other countries look for killers, for more than 30 years, the advanced DNA processes help a lot to convict murderers after many many years. in SA they 'loose' files and dna monsters without even thinking about it, so I am afraid, the killer is still out there!

Why did Fred hire the same DVD a few weeks later ? That was never explained. She was murdered by someone who knew her, and in whose presence she felt comfortable. The police appear to have falsified evidence to bolster their case, but they didnt necessarily have the wrong guy. Perhaps we have our very own OJ now ?

What About Inge's parents' hardship. They lost a beautiful daughter and only child. To top it all, because of the police's incompetence the killer is still at large. If it was my child I would sue the Minister of Safety and Security!

I would hate to go thru the same ordeal, however @least he got the right verdict in the end.Like Sean says what about all the others that don't have money for good representation.But i don't think this is a problem only for this country, cuz other countries have the death sentence where many innocent people are executed only to be found innocent after they are dead. Its not fair but shit happens..

A good article and I agree with what you are saying, but we can also look at the question in another way - How many criminals/murderers has gone free with the help of a good defence team? - Maybe we have our own OJ's. I personally know of cases where people were guilty of a crime, but with a good lawyer and some legal trickery they went free. I am happy for Fred though and wish him all the best.

Shocking. Time and money wasted because monkeys are running the zoo. The media sensationalised this case to the max meanwhile people are being shot and hacked to pieces with pangas on farms, "on the radio now" 240 000 rapes per year is SA that amounts to 657 rapes per day!!!! Even Sundays and xmas!! I am considering leaving my beautiful country to give my children a safer life. I just can't believe that the rot has reached the current levels. What is happening?

The law is an ass and the justice system is build around it. It is staffed with the people, some good, some lazy, some not good at all. The results? Some good, some bad. Maybe the majority of judgments is correct. Indeed, justice for the rich could be more correct than justice for the poor! Any suggestions to improve on this?

It seems that standard operating procedure for our police investigators is to mess up in their investigations either causing guilty people to get away on technicalities, or causing innocent people to be dragged behind the SUV of the justice system. Unfortunately there is apparently no recourse against this incompetence. By the way, 'begs the question' shouldn't be used where 'prompts the question' is what's intended (though dictionaries now sadly include this bastardised meaning).

and dedicated law enforcement officers. You can have as much money as you want, if the evidence is clear and obtained the correct way, then you WILL be found guilty. The evidence was dodgy in this case, also the way it was obtained, and that counts in Fred's favour.

I live in a (so-called) security complex not far from where the unfortunate young lady lived and was murdered. One can't but wonder if the killer is still in the vicinty and has been watching the farce of charging the wrong person play itself out. I am not by nature a fearful person, but I too live alone and have no choice but to take any security risk as serious.

1. They did not process the crime scene to implicate him. He only became a suspect later. This is the real reason why the print on the DVD was in dispute as the police returned it. Not exactly what to do if you are trying to frame him. 2. OM security sustem is not so sophisticated. Ask anyone working there who has "borrowed" a friend's card to leave the building.

are the soft targets. People have that false feeling of security (we are being guarded by a boom or a gate or a guard) meantime they work with the perpetrators and secondly it happens that people leave open their doors and windows because they feel safe and secure in a security complex, so anyone walks in, even signs in "batman" and attack the innocent people.
