Pietermaritzburg - A VIP protection unit member was not attending to any emergency when he allegedly shot out the tyre of a motorist he was overtaking, a packed Camperdown Magistrate's Court heard on Wednesday.

However, he was in a hurry to pick up KwaZulu-Natal social development MEC Meshack Radebe, who he was tasked with protecting.

"According to the driver (of the Golf) they were supposed to report to Radebe, but then they got a call saying that they must be there (earlier) at his house in Waterfall (near Durban) at 08.30," investigating officer Inspector Jerome Mngadi told the court.

"They were rushing because they were late. There was no emergency," he testified.

Accident

Constable Hlanganani Nxumalo, 28, of the Alexandra Road police barracks in Pietermaritzburg, allegedly shot out the tyre of a Mazda on the N3 near Camperdown on Saturday morning.

The driver of the car lost control, veered into oncoming traffic and collided head-on with a bakkie. There were six people in each car. Eight of them were injured.

Questioned by Magistrate Thys Taaljaard, Mngadi conceded that, had it not been for witnesses noting the registration of the Golf, police would not have known to whom it belonged.

He said witnesses reported that the Golf had its blue lights flashing and the driver was flashing its headlights to urge other motorists to get out of the fast lane.

Mngadi said police records showed "it (the Golf) belonged to the Department of Social Development and that it was driven by police who are bodyguards of social development MEC Meshack Radebe".

'Proceeded as if nothing had happened'

According to Mngadi, he was told that "the Golf proceeded as if nothing had happened" after the accident.

Mngadi could not confirm claims that the driver of the Golf - identified in court as a Const Ndlela - or the passenger stopped further along the N3 and told Road Traffic Inspectorate officers of the incident.

He said Radebe arrived at the Camperdown police station with Nxumalo, who was then handed over to the police.

Mngadi said he was still waiting for a statement from a member of the police's collision unit, who witnessed the accident.

Nxumalo faces eight counts of attempted murder and one of malicious damage to property.

Bail opposed

Opposing bail, State prosecutor Rakesh Keshurpersad said the onus was on Nxumalo to show why it would be in the interest of justice for him to be released.

He said he had not shown sufficient reasons for his release and could face up to 40 years imprisonment if convicted.

Earlier, the Democratic Alliance called for the prosecution of the driver of the car, describing him as Nxumalo's "accomplice".

Radley Keys, the party's provincial spokesman for transport, said Ndlela should face the same charges, because he was an "accessory to the fact".

In response, police spokesperson Superintendent Henry Budhram said police were busy with investigations at this stage.

"The possibility that the driver may be charged cannot be ruled out at this time," he said.

Hopefully these animals will be put to justice, they are grossly abusing the power they have, that includes the MEC's. I've witnessed many incidents, although not as serious as this one, but they seem to be above the law, with their arrogant attitudes and their seemingly "untouchable" bravado when it comes to imtimidation and utter disregard for public safety. Let's hope things start changing!

The only time that emergency vehicles / police vehicles may disregard the rules of the road is if there is a genuine emergency. being late to pick up an MEC is not such an event. This shows the total arrogance of the powers that be at the expense of the law abiding citizens. I hope those involved ( victims ) are also considering civil action against the perpertrators.....

This incident put the lives of 8 people in jeopardy, that is the bottom line. I'm sorry but the lives of all our citizens should be treated as absolute paramount, thus and Nxumalo as well as the driver need to go down for this. If not killed, people may well have been left crippled for these actions. It's absolutley horrendous.

I'm not sure if there is a possibility that the driver may be charged. Quite simply he should be and prove his innocence (if possible). A crime, a horrible crime was committed by someone in a position of authority. The abuse of that authority is possibly worse than his actions as it simply adds fuel to that fear that there is nowhere for anyone to go to to lay a complaint! Will the government actually do anything - I'll bet not!

MEC's are replaced at the drop of a hat anyway, so why do they need VIP protection? In fact, if the President can be so easily replaced, why do any of these fat cats need protection? After all, crime isn't all that serious in SA is it? And seeing as we vote for parties, not individuals, who cares who does the job? Nobody is doing it now anyway...

I do apologise for my language beforehand, but this shithead must be an example to all. Dont be too hasty to call for the MEC's head. The least that is expected of his is to publicly condone the incident (which as far as I know, he has not done). As mentioned in the first poster's comments (kd) - Merely changing his pick-up time is in no way illegal. It may be an entirely different story if he instructed his drivers and b-guards to use force, break the law, and threatened to fire them if they didnt comply.

I do not think this can be evaluated on any racial what-if scenario base like one reader has tried. This is clear arrogance demonstrated by a police officer and consequences should be the same regardless of the colour of the skin of the perpetrator. When I read this I did not bother to ask what race the victims are, they are people and that is what matters, I'm sure the justice system will look at it that way.

We get these forcing others off the road in morning and evening peak hours on Modderdam Road and the N2. They drive anything from Golfs thru BMW X5 and metallic maroon Daimler. The Metro Cops take no action. When caught on camera, are they fined, and who, if anybody, pays? If I don't get out of the way, will I get shot at?!

How can you expect the "boys" to be different if the "bosses" are worse. The criminal mentality comes from the head. Earlier reports showed that Jacob Zuma is behaving exactly in the same way, speeding along in a motorcade of 30 vehicles, travelling at 180km an hour.Totally "ignorant" of local speed limits and speeding through pedestrian and school areas. Why? Just to attend some ANC campain meeting. The guy that wants to be the next president of South Africa behaves like this. Enough said!!
