NPA to appeal Zuma ruling

Johannesburg - The National Prosecuting Authority will appeal last Friday's court judgment setting aside its corruption charges against African National Congress president Jacob Zuma, it announced on Wednesday.

It was still deciding whether to recharge him, it said in a statement.

The NPA said it had studied the judgment and sought legal advice and consequently had "decided to apply for leave to appeal against the judgment".

Pietermaritzburg High Court judge Chris Nicholson set aside the 16 charges Zuma faced which included racketeering, corruption and fraud in a case in which French arms company Thint also faced corruption charges for allegedly bribing him for protection during an arms deal probe.

The grounds of the appeal would include:

  • The contention that the court was incorrect in its interpretation of the constitution and the NPA Act regarding the obligation to solicit representations before recharging; and

  • That the judgment had made some serious legal findings impacting on the operational processes in the NPA.

    "The NPA has yet to make a decision on whether to recharge Mr Zuma.

    "This decision will be made after the finalisation of the appeal.

    "The NPA will take the necessary steps to expedite the process," it said.

    Shaik conviction

    Zuma's charges emanate from the fraud and corruption conviction of his financial adviser Schabir Shaik, who another court found had facilitated payments between Zuma and Thint.

    Zuma was fired as deputy president of the country after that judgment.

    He has been charged twice. The charges of 2005 were struck off the roll when the State was not ready to proceed with its case.

    He was charged again in December 2007 shortly after his election as ANC president.

    In passing judgment, Nicholson said the core of the case was that Zuma had not been allowed to make representations to the NPA when it made a turnaround on a public statement in 2003 that although it had enough evidence against him the case was not "winnable".

    However, much of his judgment focused on Zuma's treatment during the course of the lengthy investigation.

    Nicholson considered inappropriately close the working relationship between former Justice Minister Penuell Maduna and former NPA head Bulelani Ngcuka, given the constitutionally guaranteed independence of the prosecuting authority.

    He also questioned why Zuma had not been charged with Shaik, given that bribery is a bilateral crime.

    For heavens sake,haven't we wasted enough money and time on this? JZ will be our next president so why not accept it and get on with running the country.Sure he may have put his fingers in the till but then so did his NAT predecessors.The more we beat Zuma the more damage we do to SA.

    I think there is a political motivation behind this case. The money the country is wasting on JZ saga is too much. They must just drop it and focus on something else since this case has been struck off twice. And why does it take so long to have substential evidence against JZ. I am not JZ fan but let us leave him alone and give him a chance to become the next president. Now we have to set up another enquiry to the arms' deal. GOOD LUCK MZANSI;

    Having myself been the target and victim of the powers of mass destruction of the NPA, I am fully aware of their devious, unlawful and untruthful modus operandi. The NPA acts with favour and in fear of its superiors - the Cabinet Minister under whose jurisdiction the NPA falls at the relevant time. The Act does not provide the necessary checks and balances to prevent an abuse of power. The modus operandi of the NPA ensures a conviction without a trial. Why has Maduna never been investigated?

    I think that's the right thing to do, because if the charges been drop against JZ, others criminals will also want to go free. We cannot blame them, because a precedent was formed.

    What i dont understand is how the geatest legal minds in the country can get is wrong twice. Zuma has said publicaly, that if he goes down he is taking others with him, that is an aknowlegment of guilt, why does he not just come forward, and even though the NPA is incompetant, offer him self to the court, so that if he is innocent we can move forward. If he is guilty he must go to jail, that is justice. Yes the NPa has failed, but really, who wants a presedent where we dont know if we can trust

    NPA is waisting the RSA's scarce resource i.e Money. If you have tried twice and failed because of incompetance, clearly you should let go. NPA should disclose to the public how much it has spent on the Zuma case including quantifying the time spent on this fiasco. This money could well be spent on alleviating poverty. I suspect the cost for this case is approaching R100m. Please disclose NPA.

I mean what's the point of trying to convict some one when they are 'untouchable', when they have a youth league in their control who consider violence and intimidation to be democracy?     JZ will not necessarily be our next president - don't give up. There is much that can happen between now and the next election. Whether the NAT politicians were corrupt or not is debatable, but irrelevant - it does not make it right or even ok. We need to do our best to keep corruption out of our governments - or at the very least to a minimum - maybe our taxes will come down or the standard of education, housing, medical etc will improve instead of us funding the politicians, cars, holidays, wives shopping sprees in Paris, international medical care instead of at home etc. - wouldn't that be nice?

    The NPA is correct by appealing last Friday's ruling. If they don't then that will justify the finding by the judge. Also the NPA has to appeal in order to determine whether another court judge will have the same findings as the previous judge. It will also be able to prove that the decision to charge Zuma last December was taken independently without influence from the Executive.

    Good move. Zuma needs to answer to many allegations against him. He can't just dodge and hope that everyhthing will just disappear. There are fraud and corruption cases that he needs to the us about. What about tax evassion and racketeering caseses? I believe Judge Nicholson connived with Zuma and his camp to squash this case. they can't succeed. Lwa should take its cause. Viva NPA viva...down with corruption down!!!!

    I think there is just allot that is happening is South Africa and people are blinded from the truth. Let?s talk things are out, Shaik was found guilty for many laundering and bribery as he was working with and for Zuma at that time.     If amounts of money was paid out for the arms deal, I'm sure an audit can determine where all the money went and came from. Also the arms that was bought is believed to be in a state of disrepair, why does it take so long to do an investigation, if looking at past cases where money was involved, it was never returned anyway.     For as long as justice is still black & white, there will never be any reconciliation. Mark Thatcher was let off. Glen Aglioti? Zuma is black and is presumed criminal. This is bulldust. The sooner people accept that Umsholozi is our next president, I repeat PRESIDENT, the better. Always making noise when the media passes judgment against an african leader, yet quite when fools like Mark Scott-crossly or whoever he calls himself are let free. We need a change in attitude.

    Why does the ANC revere its criminals? Thinking of Yengeni carried in triumph to jail. ANCYL prepared to kill for Zuma. The trouble in getting the chief of police arrested. The condoning attitude to parliamentarians who commited fraud. Government should protect the public and not abuse the voters and taxpayers.     I also wondered why JZ was not charged with Shaik for the bribery, since it takes two... Seems to me that the NPA is a two-faced hypcrite making us belive that they are for the people whilst behind back doors they really don't want to see Zuma behind bars. I just knew this case would fall through immediatley when Shaik was the only one convicted. They are just wasting our money that could have gone to alleviating poverty or boosting our economy
