Pretoria  - The driver of a car in which a woman was shot dead by police, Air Force pilot Simon Matibela, said he slowed down when he saw a police vehicle with blue lights behind him.

The police apparently mistook Matibela and his three friends, Andrew Tshingo, 26, Sophie Kgagare, 29, and Olga Kekana, 29, who had been on their way from Stinkwater to GaRankuwa, for hijackers.  

He said moments after slowing down, the first bullet came through the car's rear window. 
 
"Andrew jumped from the back seat and switched on the hazard lights, to show the police that we aren't criminals.

Bullets rained down

"When my car came to a stop, the bullets rained down on us for about 20 seconds. They shot at us from behind the car and from the right-hand side."

"There was utter chaos and screaming. We looked for shelter, prayed, and hoped we would survive," said Matibela.

But Kekana didn't survive. She was shot in the head and died instantly.

When the police stopped firing, Matibela got out of his car and lay on the ground. He showed his air force ID card "to prove that I'm not a criminal".

Cops fled

While he was lying on the ground, the policemen who fired at the car fled without saying a word.

"What went wrong with the procedures the guys (police officers) should have followed? I'm still trying to fathom what they were thinking.

"You shoot when being fired at, not when a car slows down."

Matibela said when he saw photos taken of his car at the scene he "wondered how I survived that".

Tshingo was wounded in the leg and hand is and still being treated at the George Mukhari hospital.

Kgagare, who was also injured, has been discharged.

The car the real hijackers had stolen was later found abandoned a few blocks from where the shooting took place.

Zuma blamed

Matibela partly blamed Zuma for the shooting.

"The president made a mistake by giving police powers that they could not control," Mathibela said.

However, Zuma's spokesperson said the president never used the words "shoot to kill" in his recent meeting with about 1 000 police station commanders.

"This is a phrase that has been coined by some in the media and its use has been very unfair and misleading," said Zuma's spokesperson Magwenya.

At the meeting, Zuma expressed support for an amendment to Section 49 of the Criminal Procedure Act that would give the police more leeway to shoot in dangerous situations.

Zuma did make it clear at the meeting this did not mean police officers should be "trigger-happy".

The ICD had taken over the investigation and dockets for murder and three for attempted murder had been opened.

Eight firearms were confiscated and would be sent for ballistic tests.

Cops must issue order

Johann Burger, from the Institute for Security Studies, said that, given the current climate of violent crime in the country, the police should issue an order stating that members in unmarked vehicles are not allowed to pull people over.

Burger referred to countless incidents where criminals professed to be the police and then robbed or hijacked people.

Shocking.... absolutely disgraceful that cops could get away with this.
Remember the fall-out in London when the cops mistakenly killed an innocent commuter (Mendes), thinking he was a terrorist, and the investigation and inquest that followed? SA must do the same - cops are not above the law. Granted, we have serious issues with crime, but then the police force needs serious guidelines on the circumstances under which it is permitted to fire on people. A car full of people, that subsequently slowed down for the police, did NOT indicate a threat and therefore this should never have happened. Did the police formally identify themselves? Did they demand the occupants get out of the car with hands raised??? Surely that's the first step - if they were to pull firerms, and SHOOT first then there would have been reason to fire upon them, but this is just outrageous. Is this a symptom of our police training?

This is just Crazy! I've been chased before by unmarked car late at night after leaving the airport - i did nothing wrong - but something felt very wrong with the situation - i sped off - but it could have been much worse for me.

1. The same media that called for wider powers for the SAP FORCE to shoot are now beginning to realise what the effect of their propganda could be.
2. The police do not need more powers, they need better trainig. They have more than enough power to abuse.
3. Zuma and Bheki Cele are to be blamed for this. The message that they sent via the media was that police should shoot to kill.
4. This incident shows how important it is to regulate the powers of the police to shoot strictly.

This is a DEFINITE no win situation. On the one hand the police think they have a license to kill now, and THIS is what happens. Then their is the training situation, I doubt VERY MUCH that they are getting proper training, then on the other hand, everyone knows that there are probably more criminals in the police force than outside. So like a said if their were ever a lose lose situation This is it. It do not matter what good intentions the President or Ministers or whoever have, If they don't sort out the training of Policeman, Disipline as well as root out the evil among them, nobody has a hope in HELL!!!!

my sympathies to the innocent victim. HOWEVER, never ONCE was it said that police were to fire randomly, JZ said that if someone draws a firearm, the intention is clear and THEN ONLY can the police take action. Sad though, how TRAINED police officers can't tell the difference between a conquest & a corolla! do they not get charged for leaving the scene??

Those cops must be charged with murder and attempted murder,if you look at it their live was in no danger cos non of the passanger had a weapon on his/her hand they were never supposed to shot if the case be a driver didn't stop that clearly says they were suppose the give a chase not shot,I'm also concern about the number of cops that losses their live on the line of duty trying to protect us but this is a differrent case. The message was clear they should shot when one's life or their life is in danger at that moment.Not because one wouldn't stop on their blue light

Police have a procedure which they did not follow in this case. I do not believe it is because of what Zuma said. The police force needs to discipline which it currently does not have.

I pray for strength for Kgagare's family and wish Tshingo a speedy recovery.

Take the police to task on this cause this is not acceptable.

President Zuma is a victim of press sensastionism with respect to police firing on criminals. All citizens and police need the right to protect ourselves, but not to just kill indiscrimnately. The police officers involved in this shooting should be tried and jailed for attempted murder.

How sad is this? To think the chanting by various Leaders for the "Shoot to Kill" law to be passed, we now see and understand this is going to capitulate into a FREE FOR ALL by SAPS.
Dish out more STRINGENT SENTENCES, to these criminals, let them know that SEVERE sentances will be implemented by our judicial courts, and not a 5 year break in "Camp Hotel" (jail).
There is NO deterent for these criminals to fear the justice system.
God HELP South Africa!

I cannot even begin to comprehend what these innocent people felt at the time of their onslaught nor can I comprehend the anguish that Kgagare's family must be going through. If the officers of the SAPS cannot even distinguish the difference between a Corolla and Conquest - actually how can they when they are clearly not trained properly or at all, they cant even take a statement at the station, you have to use drawings to illustrate, why are we astounded - were the officers lives in danger ... hence the ambush ... God help this country.

This is absolutly wrong, how do fire at a car that is trying to stop, the victims even tried to alert the cops with the harzards. Those cops are the criminals and the only place they belong is in jail with their friends who are murderers as well. After commiting the crime the cops fled to show that they couldn't take ownership for their misconduct. Why give a policemen the right to kill harmless people "shoot to kill" is not the way to bring peace in SA. As for everyone who thinks this is a good way to go about it, asking for death penalty, wait until you fall victim to this and then start talking.

I still think the "shoot to kill" is good, however, only in a situation where the police know for sure that they are confronted by criminals. I was thinking about the situation, and wondered how easily I would have stopped my car, with all the bogus cop stories, I think I may have been pretty scared to stop! The question I would ask would be why the cops fled the scene, if they thought they were doing the right thing.

I was pulled over by an unmarked police car, when I was still trying to access if this are real police a gun was pulled by one police and he said I was disregarding their orders and they shove me out of my car and said I was drunk. It was around 22h00 how can you be expected to stop for an unmarked car by that time now ??

This is realy not good at all,we should trust and feel safe with our Police but nowadays we are even afraid to drive at night because is them who are making people to be doubtful of.I went through the same but luckily it was during the day where i just parked the car along side the road waiting to my girlfriend they just came and pointed the gun at me i was scared they were gonna shoot me as they are given power.

@ Agnes and the commentors above - how many of you have served in the SAP or SAPS? No criminal asks the police to first draw his firearm before they shoot. Generally a policeman has a few seconds to decide what his course of action will be, and then the critics have hours and days and weeks to analyse the incident. In the present climate it is almost a case of shoot first ask questions later. Sadly this type of situation does happen. If one reads the article the vehicle which was being looked for was found in the vicinity, thus they had reasonable grounds for suspecting the vehicle they were following COULD have been the circulated vehicle. What I do agree with is that ALL police vehicles should be marked , have blue lights and a siren with a PA system. There can be unmarked vehicles for when clandestine work is required, and which can be requested from a pool. Unmarked vehicles are open to abuse by members. We have not heard the side of the members who fired the shots - what were their actions in trying to stop the vehicle? generally one would try and stop the vehicle by firing first at the tyres. Many colleagues are lost when criminals fire on policeman, and many are saved when they have taken the iniative first and fired first. So yes, let us feel for these innocent persons killed and injured, but let us see this from the side of the police as well. I think many of you will fall on your backs if you knew how many policeman are suffering from PTSD and Depression due to thier efforst to keep this country safe - and yes theri are corrupt cops, and until the system is changed where you can get rid of them easily, that will remain so.

@Kaltie, i couldnt agree with you more, sometimes you end up wondering what the media really wants to achieve at the end of the day, i guess it all comes out to how sensational your story is, and how many hits you get, or papers you sell at the end of the day, nothing to do with substabce or what the nation is supposed to benefit at the end of the day, Now i understand why people say newspaper editors and a bunch of pipms and reporters a bunch of prostitutes, no foffence intended.All they do do is twist facts and sensationalise stories. For the case in point, not many facts have been given to us as the public, at first we were told that the car was running away, if so why were they running if they were not guilty,now they say the car had stopped(or slowed down), which ever makes the story more sensational, we are told when they started shooting, or whether the guy stopped because they had started shooting, either way, a proper investigation needs to be carried out, and if the cops are guilty of something they should face the full wrath of the law, before that, pleae let us not try them in the newspapers, once they are found not guilty, we will start crying about breakdown of rule of law, because we already have our verdicts, that have been stuffed down our throats by the media, through its sensatinalist antics

In total agreement with you, how can they just start shooting if the would be "hi-jackers" were not shooting at them, like you said "did the police identify themselves, did they ask the occupants of the vehicle to get out of the car" or were they happy with the "shoot to kill" statement, they need to be in prison not suspended following investigation, a woman is dead the photo above is clear enough evidence to prosecute these cops, it is done abroad it must be done here as well

Firstly, I have great sympathy for the family & friends of the deceased person and wish this never happened. However, having been a cop and having been in the same situation, I understand how and why this could happen. Policemen are only people and when your are under fire on a daily basis you get very jumpy. Only a person that has been in this situation before knows the fear and adrenaline of the moment when you realize this moment may be your last(ask any crime victim!). If this was a high jacked car, we would applaud them for taking out the vermin -> now everybody is screaming bloody murder. There will be an investigation - let's get all the facts and in the meantime support the "Pote", incompetence and all!!

@KaltieIf the police felt within their rights to do what they did, can you explain what would happen in these scenarios1. The hijacked victim is in the car held hostage by the hijackers. Do you feel justified that an innocent person who might be a victim of the hijacking does deserve to be killed? What if the driver was also being forced to drive and had no option?2. No shots were fired at the police and they were not in danger? Why not chase the vehicle at a distance until you have ascertained that no innocent victim was in the car?3. If the police were sure what they did was right, why did they not effect an arrest? Why did they run away and why did their colleagues apologise?4. If you are trying immobilise the vehicle, why not shoot out the tyres, as that would eventually stop the car?5. How can you shoot at a car when you are not even sure it is the right car? How many gray Toyota Corrolas are out there in Pretoria?Surely even you realise that if police are given such powers, there will be stupid idiots who do not think properly and will simply act without thinking.also, I find it odd that you want everyone to wait for the facts before judging, but have already made judgement about the matter without getting full facts.I would not wish this to happen to your family, but I suspect you already know it would not happen to your family because you are the right colour.Imagine your family member is in the boot of the car, a victim of a hijacking and police fire bullets at the car without thinking. Imagine you were in the boot of your hijacked car or your daughter was held down by the hijackers when the police started firing. I suspect you will not feel this way. We seem to support draconian actions as long as those close to us do not suffer from it.
We supported apartheid because it was other people suffering from it. German supported Hitler because Jews were suffering from it. During Bush's term, Americans supported denial of civil liberties of anyone that was different to them because it was not them or their families suffering.
I cannot wait for the day you will try to convince everyone of how bad the police are, when you experience their utter incompetence.

An innocent woman lost her life, because the cops could not establish whether it was a hi-jacked vehicle or not, so please read the article, read the comments following understand what is being said and then comment....sheesh!!!!!!

Also, I would urge the members of the families to sue Nathi Mthethwa and Bheki Cele both in their capacities as Minister of Police and Commissioner, as well as in their personal capacities as political leaders whose statements carry some weight. I would contribute to any fund raising efforts to sue the pants off these thugs Cele, Mthethwa and Zuma)

Strange how something like this gets a huge amount of publicity when the actual criminals get very little except for the initial report. Where is the justification in that. Have we heard any more about the innocent bystander that was deliberately shot in the head after a criminal purposly ran up to him during a robbery on the East Rand? Every body is up in arms about the cops shooting somebody, but where is the outrage against those bastards that rob and kill at shopping centers?

@nico van rensburg, Policeman in Zimbabwe are fit enough to deal with most criminals without resorting to guns. They cannot afford guns. Only special units and the army use guns. Instead of shooting to kill, get police to be physically fit and train them to deal intelligently with crime. Dishing out guns and uniforms to people won’t solve the crime problem but will make it worse since the guns will find their way to criminals. I suspect most of the guns used by criminals leak from the police.

The fact is THESE COPS DID NOT KNOW THE DIFFERENCE BETWEEN A CONQUEST AND A COROLLA.
I am humbly asking my president (I am a law abiding taxpaying and gun-free citizen, and so are most people in this country) this question. If I as a law abiding citizen is shot and injured or killed, because in that moment of panic, I decided to not stop when an unmarked police vehicle flashes its lights, but decide to go to the nearest place of safety or police station, will Messrs Zuma, Cele and Mbalula guarantee that I have recourse. In the event of an injury, recourse in lieu of compensation from the Ministry of Safety and Security or the Presidency or both. In the event of death, that my estate is not taxed by the same government that killed me.

I sympathise with the victims. An innocent life was lost due to a lack of common sense on the part of the police. Its not rocket science, and it was explained in the media, that police now have a right to DEFEND themselves when under attack which they were extremely limited to before. Even if they were chasing the hijacked vehicle, they should only have discharged their weapons if the criminals attacked or did something that would warrant defensive behaviour. I agree that this shows a lack of training on thepart of these cops. The problem now is whether 1) The guilty officers will be charged and face the consequences [when so much gets swept under the carpet nowadays], 2) whether they will actually address the problem of lack of training and ensure our SAPS are thoroughly equipped with KNOWLEDGE prior to being deployed so as to curb the incompetence that seems to be breeding in this department, and 3) Whether someone will actually offer an apology and some symapthy to the victims families [granted it won't help them much especially not the family of the young lady who was murdered, but it would at least show a little known thing called compassion which seems to be dying out in this country]. If those who took an oath to serve and protect are capable of leaving injured victims at the side of the road...what does that say about the state of humanity in this country?

I am very much scared and indeed very very very scared. I am even scared of driving late coz i was nearly hijacked last time by unmarked vehicle but i was quick to respond before they can do that. U know this situation is very tricky considering the fact that the police were never proved at the first place even though we are not quite sure at the moment about who is speaking the truth. Let the police know where to shoot and where to negotiate and if they cannot negotiate then let them go back to negotiation classes..u cant just kill innocent people and say you sorry you idiots because thugs are killing police? Shame of the month goes to police.

Who in his right mind pulls over when and unmarked car with a blue light and occupants who appear to be dressed like cops indicate you must stop. Forget it, hit the gas and head for the nearest police station.

It is one thing if a person points a firearm at a policeman but totally different if scared people refuse to stop. Fake 'policemen' rob and rape people on a daily basis. Why did the police start shooting? Nobody was shooting at them? They should all be tried for murder! This could happen to your child or wife next week!

Its so easy to judge now with all the time in the world, most people have no idea how difficult it is to make split second life changing decisions, the REAL car which was identical to this one was found a SHORT distance away, so in actual fact these cops were racing around HOPING to find the real hijackers at huge risk to their own lives to arrest the real criminals, now they find an identical car at that time of the morning not very likely so now: what if it was the real hijackers and the cops hesitated and got killed themselves. Im not saying it was right by any means but in that split second its him or you its not easy. People must realize this and not play games with police , listen carefully to instructions and dont make sudden movements, its common sense.

i dont why Zuma should be partially blamed when he stated clearly that Police should use maximum force only when faced with armed criminals...very clear to me. i'm sure he does expect professional judgement from the police when faced with such incidents...in this unfortunate case police acted unprofessionally and should face legal action. we should remember that this happens in a backdrop of violent criminal who are ruthless enough not to think twice about taking innocent life including that of police.

Down we go, swift slippery slope. Cape Town just set up a traffic unit with a lot of unmarked cars, to catch offenders. Now they'd better rethink this. I am NOT intending to stop for any unmarked vehicle, and I am also NOT going to permit cowboys to kill me in consequence. I am going to get some member of parliament to put forcible questions in the house, and get the police ministry to make up their minds about policy, and get focused on training the police. Until public rhetoric and the law are properly aligned, and sorted out, I do not advise anybody to come here for the 2010 footie. It's going to be a recipe for disaster the way things are moving at present.

And what's beyond belief is that they shot up the car, killed someone, injured others, and did not follow up, did not stop to check the results, did not stay with the people, did not offer assistance. Police! Polity? Polite? Policy? Polis = city = civilised behaviour? These guys behaved like a death squad!
