Mbeki fights back

Johannesburg - President Thabo Mbeki has ushered in a new round in the fight against the Zuma camp in the ANC, with an urgent appeal to the Constitutional Court.

Mbeki wants to have "remarks made in passing" by Judge Chris Nicholson that he had meddled in Jacob Zuma's prosecution, set aside.

On Monday, experts on the Constitution said it was a clear indication that Mbeki "had not thrown in the towel" and that "anyone who thinks that the fight between Mbeki and Zuma was a thing of the past, lives in a fool's paradise".

The passing remarks to which Mbeki refers in his affidavit to Chief Judge Pius Langa, are those made by Nicholson in his ruling in the Pietermaritzburg High Court earlier this month.

Nicholson ruled that the National Prosecuting Authority (NPA) had not given Zuma the opportunity to make representations before deciding to charge him again for fraud and corruption, amongst other things.

At that stage Zuma had just been elected ANC president in Mbeki's place.

Serious allegations

Mbeki says in the affidavit that, instead of focusing on the issue at hand, Nicholson went much further of his own accord, saying in passing that Mbeki and the ministers serving or having served with him, had meddled in the NPA's decision to prosecute Zuma.

Mbeki says these are serious allegations against him, not only in his personal capacity, but also as head of state, and they had resulted in him having to resign.

He argues that Nicholson had no right to make remarks of this nature without giving him and the relevant ministers the opportunity to state their case in court.

Mbeki states that this has affected his constitutional rights of human dignity and access to the courts. He argues that he should be given direct access to the Constitutional Court in order to have the "false" allegations set aside.

As Nicholson's remarks were not court orders, an appeal cannot be lodged against them in a Court of Appeal. Only the Constitutional Court now has the power to intervene, Mbeki argues.

Mbeki 'has strong chance of success'

Professor Marinus Wiechers, former law professor at Unisa and an expert on the constitution, thinks Mbeki has a "very strong chance" of success.

"I was astounded when I heard Judge Nicholson make his statements on Mbeki and the executive. That was not the legal issue he was required to rule on. I thought he should have let it go.

"One thing is certain: Mbeki's appeal is proving wrong all those who thought he had gone quietly, as Sunday night's dignified speech on TV could have indicated.

"On the contrary, he is clearly ready for battle, and upon close examination, Monday's appeal is nothing other than a veiled warning to Zuma that the Mbeki-Zuma fight is far from over."

Professor Tom Coetzee, former law professor at North West University's Potchefstroom campus, said he considered Nicholson's statements on political meddling in the Zuma prosecution as "neither relevant, nor fair".

"I was astonished. The Constitutional Court's ruling will be groundbreaking. Mbeki is taking the right route. No one should underestimate his intelligence."

It is time that somebody stood-up against the "new administration" who seemingly have no respect for the people of this country, let alone the judicial system. Why not call an early election while still in the seat - the outcome will be in your favour! I am willing to donate funds for your new party campaign ....

I agree that Judge Nicholson should never have mentioned what he did about Mbeki. He was never asked to make a ruling or pass comment on that particular issue and his blabber-mouth just proves that he is one of Zuma's cronies. Although I'm not a fan of Mbeki I am glad in a way that he is fighting back but this may be cause for concern for us law abiding South Africans. What this will do to the economy remains to be seen. So here go South Africans !! Let's enjoy this power struggle ride !

The Squire's judgement found Shaik to be corrupt - which means that there was someone 2 parties involved therefore the remarks regarding Zuma. Nicholson was ruling on a point of law regarding procedures around charging Zuma. Very different and had no testimony about Mbeki's (alleged) involvement and was therefore out of order to make a baselesss remark in a judgement of a seperate matter. Was he interfeered with by the Zuma camp? Nicholson is a pot calling the kettle black.

people should stop complaining and enjoy the freedom that democracy gives you. in a foriegn country such issues do exist but are bottled up and never reach the media. The Judge has added fuel to a fire. This Judge Chris Nicholson needs to be remove from this position. He demonstrated his incompetence at a time when it really mattered. It has nothing to do with Mbeki's revenge "Mbeki is taking the right route No one should underestimate his intelligence".

its about time that President Mbeki's corner got out into the ring and show the Zuma camp a thing or two about politics, the fight has only just begun and atleast he cannot lose the presidency as a result of the results, the worst case senario will be that President Mbeki will win the case, open up another docket against Zuma and start his own opposition party...

I am really glad to see Mr Mbeki defending his honour and integrity.Very unlike Zuma,who is accused of so much ugly crimes but does not make an attempt to prove himself innocent.Obviously Zuma is not a man of integrity or else he would not have said that if he is prosecuted for the Arms Deal Saga,that he would take many others down with him.Strangely,that was also mentioned in Judge Nicholson's ruling but Zuma's suporters seem not to see it !??!!! Are they blind or ignorant ? Way to go Mr Mbeki!

I think Mbeki's fight back against the judgement of Judge Nicholson will further reaffirm the view which his main critics has sought to charactarise him as an power hungry, arrogant perfectionist. Who is Mbeki to determine what Judge Nicholson should or should not say afterall.It was the very same Mbeki who fired the the Anc President on a Judgement that Zuma was forbiden or not given a chance to defend himself.

Jugges in this country think they are above everything and they can say what ever they want, similar case happened some years ago in the free state, where a judge went on to something else living the case at hand, when the accused told the judge he was way off the case he was given three months on top of his sentence

I think it is a forthright thing that Mbeki is doing, his name was unnecessarily cast into the pigsty and he consequently resigned. If his application succeeds, it will go a long way in restoring his legacy.

Yeah I was also surprised that the judge chose to talk about things that were none of his business. The case was about zuma and the npa following procedure not who may on influenced tham. i think the judge should resign or be fired.

I was shocked to hear that mbeki has resigned and my first thought was , oh crap, Zuma is going to be president. Mbeki did not treat his presidency as he should have but he is a better president than a criminal(zuma).

I agree with President Mbeki for his appeal in ConCourt because its devastating to put all allegations like that to a person. As a South African its a right thing for him to fight for his Human Right. I know this may seems to be a fight against Zuma Camp but let take it positive by saying Mr. Mbeki is trying to clear his name

power is just a one moment thing and should not interfere with striving to make south africa a better country. in doing so, we should have honest and reliable politicians who are not divided or in constant war with each other because they are power hungry but i donot think that they know and acknowlegde that because people cannnot change what they do not acknowledge. members of the ruling party just do not get it!!!

I am glad that Mbeki is taking this route. His argument is very strong. I just hope that many sober thinking South Africans will stand behind him. We cannot allow politicians to play political games that distract government from excercizing good governance. This whole saga is unecessary and costly. I am dissapointed with the Zuma camp.

How can anyone be called a competent judge when he passes remarks like he did in the Zuma judgement. I then have serious doubts about the "impartial" judiciary. Did the judge accept a bribe?........To fuel the fire of an already discontent ANC is not only dangerous, but will definately have far reaching consequences for us average populace. Do not be suprised to see the Rand take a head long dive into unknown territory, with the result that jobs will be lost etc...investor confidence?

I am not a Mbeki OR Zuma fan, but while they are fighting each other, they are leaving the rest of us in peace. Mbeki is at least making an effort to prove his innocence - more than Zuma even tried to do. Zuma will become president next year and the new lying, cheating, stealing president will embarrass the ANC so badly they'll wish they never heard of him.

The assumption that Mbeki have meddled in the case by the NPA against Zuma, cost him his position. The judge ruled that the NPA faulted by not giving Zuma an opportunity to give his side of the story. The ANC rejoiced and ousted the president, and not giving him the opportunity to give his side of the story.Hypocrites, half of them.
