Paris - France has said that it will not give evidence to the US on September 11 hijacking suspect Zacarias Moussaoui.
The US wants the death penalty for Moussaoui - a French citizen.
But France opposes using the ultimate sanction.
"We shall continue judicial co-operation," said justice minister Marylise Lebranchu. "However, under no circumstances shall we transmit a piece of evidence if it could be used to back up a death sentence."
Moussaoui, a 33-year-old of Moroccan origin, is charged with conspiring with Saudi-born militant Osama bin Laden and his al Qaeda network in connection with the hijacked airliner attacks on New York and Washington, which killed more than 3 000 people.
France abolished the death penalty 20 years ago.
