Brickz neither committed a crime nor threatened to kill anyone.

Award winning musician Brickz neither committed a crime nor threatened to kill anyone, the Roodepoort Magistrate's Court heard on Wednesday.

"The accused was never arrested from March up to when the charge was laid in October because no crime was committed," the Kwaito star's lawyer Isaac Mokgopi said during his bail application.

"He never threatened to kill the girl or [his] wife."

The girl at one stage stayed with Ndlovu's wife.

Brickz, whose real name is Sipho Charles Ndlovu, has been in custody since November 1 for allegedly raping the 16-year-old girl in March. In an affidavit, he denied raping her and that he intended pleading not guilty.

Mokgopi asked investigating officer Warrant Officer Joel Ngobeni why Ndlovu was not arrested in March, or on October 14, when the rape charge was laid with the police.

Ngobeni said he did not know why as he only took over the case on Tuesday. He said Mokgopi was wrong when he said Ndlovu did not rape the girl or threaten to kill her and his wife.

"If that was true, the matter would not be on the court roll," he said.

The bail hearing continues.
