Ex-cop and wife to get R120 000 after being caught having sex in car

An ex-police officer and his wife will receive R120 000 from Police Minister Nkosinathi Nhleko, after they were falsely accused of prostitution for having sex in their car.

Emile Drotsky, a father, and his wife were arrested at Magnolia Dell Park in Pretoria in June 2009. At the time of the arrest he was still a member of the South African Police Service.

He lived in Pretoria, but had since moved to KwaZulu-Natal.

The police officers accused his wife of being a prostitute, sprayed Drotsky with pepper spray, and then assaulted him in the Sunnyside police station’s holding cells.

The couple faced a charge of public indecency for having sex in public. The case was withdrawn and a settlement was reached in the High Court in Pretoria this week.

Drotsky’s attorney, Jean-Paul Rudd, said the woman also instituted action against Nhleko and received R50 000 in compensation in June 2015.

Drotsky received his settlement offer on Wednesday, Rudd said. The court ruled that Nhleko had 30 days to pay the amount to Drotsky’s attorneys, failing which he would have to pay interest.
