Man caught raping woman jailed for 7 years

An Mpumalanga man has been sentenced to seven years imprisonment after he was caught raping a drunk woman whose husband was also inebriated.

Lucky Mbuyane, 34, from Mahushu near Hazyview, was sentenced when he appeared in the Nelspruit Regional Court on Thursday.

He had pleaded not guilty to one charge of housebreaking with intent to rape, and another of rape.

He was arrested after breaking into a 42-year-old woman’s house in Mahushu on November 23 2014, and raping her while she was helpless.

"The victim’s daughter said after she heard her mother scream, she rushed into her room only to find you kneeling between her legs. You told her to get away and she went to call her brother for help," Magistrate Vanessa Joubert told Mbuyane during sentencing.

The magistrate said the accused, the victim and her husband were part of a group of people who had been drinking liquor at an event that night.

'You showed no remorse'

"When the victim was drunk and left to go home, you realised that her husband was also drunk. Seeing that he was staying behind, you followed her to take advantage. You entered her house, sneaked into her bedroom, strangled her and raped her," said Joubert.

She said, luckily the victim’s screams were heard by her daughter, who investigated and then called for help.

"When the child’s brother came, he saw you leaving the house with an unbuttoned trouser. You said you had a good relationship with the family and wondered why they were implicating you. You showed no remorse, despite the evidence levelled against you," said the magistrate.

Joubert said witnesses found the victim crying after the accused left.

'Liquor played a role'

She said a medical report indicated there were scratches on the victim's neck and supported the evidence given by the victim and her two children.

"The court has deviated from the prescribed minimum sentence because you all had been intoxicated and liquor played a role in the matter.

"Secondly, you’ve been in custody for 16 months. You are therefore sentenced to three years for housebreaking with intent to rape and seven years for rape. Sentences will run concurrently," said Joubert.
