Lawyers representing the miners from Marikana will be heading to court again on the 26th and 27th of this month in their third attempt to secure state funding. Their previous two attempts were all turned down and they are hoping that the High Court in Pretoria will maybe rule in their favour.
The commission was appointed by the president following the deaths of more than 40 people and the arrest more than 100 during the Marikana wage protest in August last year.
The appointment of the commission is seen as a way of shedding the light into this unfortunate incident and to identify where different participants went wrong so as to prevent similar events from occurring in the future. It is my view that it is only fair that there is fair representation for all the parties involved.
At the moment those representing the miners claim that there is no money for them to continue representing their clients, which will then lead to the miners not enjoying the same legal representation as the SAPS and the employers.
I don’t understand why the state can set up a commission and not provide necessary support for those who can’t afford legal fees.
President Jacob Zuma on the other hand, was ordered to release the spy tapes and he is going to appeal this ruling and can appeal it for as long as it’s legally possible, because for him money is not a problem, the taxpayer foots the bill. Although these two cases are not related they have one thing in common in that they both want the public to know the truth.
The public wants to know what’s contained in the spy tapes and what really led to the killing of more than 40 people. It is not fair that tax-payers money can be used to protect one man and not be used to help the more than hundred tax payers.
