Astronomical Legal Victory for Genuine Dairy Product Customers and Consumers.
In relation to all other articles I have previously posted regarding IMITATION Dairy Product/s / Substance/s which had/have and are being advertised, marketed, distributed, sold and or made /afford for sale to unsuspecting customers and consumers as GENUINE Bovine (Real) Dairy Product/s.
With names such as “fresh” cream, cream, butter cream , cheese cake etc but not limited to these names, which are in and or on and as a ingredient and or forming part of a multi – tude of food and beverage products. Product/s ,such as Cakes and or Pastries and or Confectionery and or Desserts, but not limited to these type products. For more years than can be guessed at this time as much as it is known to be in excess of 20 years and which in many if not all instances and which continues unabated as of 18/09/2012 by many entities. Which in FACT is ILLEGAL and PROHIBITED in South Africa as I have always said and proved.
I have pleasure to confirm that VICTORY in the FIRST NOVEL CRIMINAL case against a Reputable Food and Beverage Retailer has been accomplished on the 12/09/2012.
This after many years of intensive, exhaustive research and campaigning, at extremely exorbitant financial and personal cost and NOT just against this Retailer. To have the complaint/s brought before a Criminal Court of Law in the first instance.
As much as the Reputable Food Retailer Company eventually entered a plea of Guilty and afforded the court mitigating circumstances and reasons for committing the criminality against the unsuspecting customer and consumer.
The Reputable Food Retailer was pronounced GUILTY as charged by the Honorable Criminal Court in Verulam Kzn on the 12/09/2012 and sentenced to a fine of R2500 which was suspended for 5 YEARS. Whilst the financial penalty is considered extremely lenient and not befitting the crime. 5 YEARS to remain implicitly compliant with DAFF legislation and Regulation is indeed more acceptable.
Worthy to indicate there are many other leading / Reputable Food Retailers and others that will also find themselves in a Criminal Court of Law in due course, as the SAPS CCU complete their further investigations which are well advanced.
This ruling should have a astronomical consequence, effect and affect on ALL those role players in the Food and Beverage Industry, Hospitality Industry and others as a whole that had/have and or do and or will commit such a heinous, immoral, unethical, fraudulent criminal business mannerisms. IE: Advertised/advertise, marketed/market, distributed/distribute, sold and or afforded /afford for sale, various and numerous Imitation Dairy Creams/Substances as Genuine Bovine (Real) Dairy Product/s.
In closing. The name of the GUILTY Reputable Food Retailer shall remain confidential at this time due to further Civil Litigation being initiated against them but the name of the Company/Group WILL be made public notice in due course.
Whether additional Governmental intervention against them and others, as they and many if not most are still NON compliant with other Regulating Authority Legislation and Regulation. Will be/is to be implemented as was / is requested of those Regulators, is unknown and comment is reserved, on that possibility at this time.
