I recently fired my domestic worker who acknowledged that she stole a shirt from me. Despite the theft, I gave her 2 months salary when she left (will your employer do that ?) Despite this, I had to pay another 1 month salary because the dismissal procedure was flawed. The theft was not argued.
That is the new South Africa..... it is more important to prove you followed a procedure than punishing someone for theft. The employee won the case today, but this certainly sends a message to all that they should avoid hiring people(and create jobs)....it's just not worth it anymore. I won't hire someone again.
