Could anyone cross-examine?

10 April 2014, 09:13

News24 reported on the 8th April that 'defence lawyer Barry Roux, who had aggressively challenged prosecution witnesses since the trial began on the 3rd March, led Pistorius gently through events.'

However, if Oscar was a state witness would Roux have asked Oscar the following questions?

What did Reeva prepare for dinner?  Were the utensils already on the table or did Reeva bring them from the kitchen?

What did  you eat?  Was it to your satisfaction?  What was the colour of the plate?  And the size?  Was there a cloth on the table or placemats?

Reeva asked you if you wanted anything to drink?  You said yes, but you can't remember if it was coffee or tea?  I put it to you:

If it was tea was it Rooibos, Lipton, Five Roses or Joko?  If it was coffee was it Nescafe, Ricoffy or Douwe Egberts?  Or another brand?

Was this served from a mug or a cup?  Large, medium or small?  What was the colour?  Which way was the handle facing?  Left or right?

Was milk added?  What was the expiry date?  Was this in a carton, packet of bottle?  Was it fat free, full cream, skim or powdered?  From which dairy or supermarket did you purchase this?  On what day?

How may spoons of sugar did you take?  Was this Illovo, Huletts or Selati?  Was this from a bowl or a canister?

During and after dinner how long did you sit at the dining room table?  Please be specific.

On the 13th February you said that you thought Reeva would go back to Johannesburg  Why did you think this?  Did she give any indication?  What did you say?  What did she say?  And then?

You also stated that Reeva wanted to finish her washing.  What was she washing - delicates, whites  or colours?  How many loads?  How long did this take?  Did she use the drier?  Where is the washing machine?  What is the make and model?  How long have you had it?

At what time did Reeva brush her teeth?  And you?   Please describe your toothbrushes in detail.  Why type of toothpaste did you use?  Was the tube squeezed from the bottom or the middle?  Did you argue over this?

You arrived home shortly after 18h00 but at 18h00 you went upstairs change and shower or bath.  So which was it?  Are those Tivoli taps?  What was the water temperature?  What brand of soap did you use?  Did you shampoo your hair?  If so, for how long?

You ate supper shortly after 19h00.  I have already covered this line of questioning, but My Lady would like more clarity.

Around 20h00 you went to your room and opened the balcony door.  Why did you do this?  What was  Reeva doing?  Was she lying in the middle of the bed at this time?  On her stomach, her left or right side or on her back?  How long did it take you to get there?  Where did you walk from?  Was the door stuck because it had been painted?  Was the paint Plascon, Dulux or another brand?

Around 21h00 you went downstairs.  What for?  What did you do?  What did you say?  What did Reeva say?

At 22h00 you both went to bed.

You mention shortly and around these times.  Did you look at your watch each time?  Can you confirm the exact times?

Roux was not satisfied with shortly and around from state witnesses and expected them to recall each shot and scream to the second after being jolted from a foggy sleep at shortly or around 3am.

Were the witnesses expected to say:  "Boo, please find the stopwatch.  We may have to testify for somebody famous?

"Sure, Babycakes," may have been the reply, "but where would I find it?  Isn't it too late?  I clearly heard shots and screams as I couldn't sleep on the wrong side of the bed."

So anyone could be an ad nauseam cross-examiner.

But what exactly would be the point?
