DOUBLE JEOPARDY (Current interpretation world-wide)
Double jeopardy is a procedural defence that forbids a defendant from being tried again on the same (or similar) charges following a legitimate acquittal or conviction.
Note: The above interpretation is protected constitutionally in South Africa by our Bill of Rights [s. 35(3)(m)]
PROPOSED FINANCIAL DOUBLE JEOPARDY (South African Version)
Any person that receives any form of remuneration (social grant, tenders, etc.) from any State department or State owned entity will automatically receive DOUBLE the minimum prescribed sentence should they be found guilty of any offence while receiving any benefit or while in the employment of the aforementioned entities. Simply put, do the crime on our dime and get double the time.
GRACE PERIOD
Not that we should be fair but let’s allow for a grace period of 3 months for any offenders to come clean and after that nail them as per the proposed DOUBLE JEOPARDY law. Let’s see if any politician would even consider a Bill of this magnitude, if they don’t then they are not serving our country as the public servants they purport to be.
