Is Oscar an irresponsible moron?

21 February 2013, 12:00

Any gun owner has to undergo training to get a licence. I am not a gun owner but have had training on guns. I was in the Army after all and worked in the armory. Here is the thing about guns, much like a hammer cannot drive a nail if it is not in the hands of a person, guns cannot kill unless someone pulls the trigger. I am not going to go into the joys of gun ownership, nor will I discuss the merits of gun ownership, but I will say that disarming legally licensed gun owners will lead to a situation where only criminals will own weapons. England has had more incidences of gun crime in recent years despite a total ban on private gun ownership, this should tell you a story.

Back to Mr Pistorius and his careless Rambo attitude. Any capable gun instructor will tell you that guns load themselves. This is not because guns will load themselves physically but because guns are dangerous, They are designed to kill, The fact is that guns "load themselves" because someone forgot to clear the chamber. More people are killed because of this than would be believed. I personally know of at least three people that died because a trigger was pulled on an empty chamber that turned out not empty and have heard of many others, as well as people shot in the legs, knees, feet and other places because "it was not loaded".

The story about Oscar and the restaurant tells me that he was careless with guns. You never take a gun from someone that has not checked the chamber or if you do you sure as shooting don't touch the trigger, before you check the chamber yourself. Pulling a trigger by accident is almost impossible, unless the gun has a hair trigger, Any gun with a hair trigger belongs to a person waiting to shoot off their own testicles.

There endeth lesson one, now let's move on to pointing the gun. Every competent instructor will tell you that you never ever point a gun at something you don't want to shoot, I'll go even further and say that most will tell you not to take out your gun unless you are willing to use it. Oscar was willing and did, he admitted it. I am not using the word alledged in this article because Oscar has admitted to the shooting. It's just his motives in question.

The facts are as we have them. Oscar admits he shot Reeva. He claimed he was fearful of an intruder, We know Reeva was behind a locked door because Oscar admitted breaking it down with a cricket bat.  There were only two people in the house so in reality nobody has a clue as to what actually occured. We cannot speculate about the circumstances, that we will have to leave to the experts like the blood spatter analysts and the like.

I am no lawyer or legal mind but I was taught that self defence was when you were in imminent danger or protecting another in imminent danger. Imminent danger is when someone has a weapon and is going to take you out. Let me explain this in easy terms. If a bloke has a knife and is trying to cut your throat, stab you, or is threatening you, you are in imminent danger. If a bloke has a knife and is on the other side of a locked door you are not in imminent danger. If a bloke points a gun at you, you are in imminent danger, even if you don't know whether the gun is loaded or not. If someone is behind a locked door and you think he may have a gun, get away from the door, because you are not in imminent danger unless he is shooting through the door.

In Oscar's case he had no clue what was behind the door according to his own statement, yet he chose to shoot through the door. For all he knew, there was a kitten in the bathroom. He did not ask who was in the bathroom, he chose to shoot and to my knowledge no warning shot was fired. A law student will tell you that his intent was to harm whoever was behind that door, he didn't much care who or what it was. This was not an act of self defence, it was a willful misuse of a weapon. Even if there was a criminal or burglar behind the door Oscar had no reason to use the weapon.

OPINION: Oscar is an irresponsible moron that should be goaled. Oscar deserves to go to goal, whether he is found guilty of murder or culpable homicide. In reality those are the only real options in my opinion.
