Open letter to SANRAIL and the Dictatorship behind them!

Your whole company should be shot you have no morals, ethics or principals. And your whole business model is based on mafia strong-arm style tactics.

Claiming that Motorists now see value of e-tags.  IS UTTER RUBBISH!!! 

Some motorists are so intimidated and scared “of getting a criminal record” or of getting locked up and blacklisted. That they are taking the path of least resistance as they see it.

Not because they agree with the idea of E-tolls. Not because your funding method is based on open honest transparent and sound principals that have been implemented to maintain our country’s roads in the best and most efficient way possible.

And not because the current fuel levy is being managed “correctly” and it’s been found to be insufficient to maintain our road infrastructure.

Sadly I don’t think most people have read or even understand the agreement that they are signing when they agree to your terms and condition on paper or on your web page that you force untagged users to agree to if they want to see an outstanding balance. Personally I would and will never agree to your terms and condition.

Unfortunately seeing that the government has made it “law” to pay tolls by their statement in the government gazette with the comment (The obligation to pay toll arises the moment a toll gantry is passed.) by the ANC,s  own underhanded questionable dealings in the E-toll fiasco we know someone somewhere is getting something out of it pity there is no accountability when underhanded dealings do come to light..

You have left many road users with very few options seeing as there is no alternative road infrastructure that can be used in many instances and there is no alternative reliable  safe transport options that can be used. To get around quickly, safely and relatively cheaply for the average man in the street to use on a daily basis. E.g. Like systems based in Europe and the uk that eliminate the need for a car in most areas so a large percentage of its citizens can travel around safely and quickly.

So like many well intentioned people I think most road users will pay your blood money out of fear.

But road users must realize that they still have rights.

The first right is that they do not have to get a tag and they have the right to not agree to your terms and conditions that you are forcing them to agree to under duress on your web page.

And one of the most fundamental rights the right to a proper statement / invoice with photos that are date and time stamped by a reliable system. Where your data integrity is correct and the and data supplied is not manipulated and full of issues , erroneous or false and questionable information as is currently the case.

Invoices that are sent in a timeously manner by your company not a threatening SMS because you and the “so called working systems” that you have implemented are not up to the task. 

They must realize that they are entitled to various discounts as stated in the government gazette. Something you continuously neglect to tell people. That discounts are applicable even after the 7day BS period where you have not bothered to issue an invoices!

It amazes me that you take a function away for a non-registered user to check there outstanding balance if they so choose to. And you force them to register and agree to your terms and conditions really.

Then you make it near impossible for them to pay you if they chose to without wasting hours in there day.

Typical mafia tactic pay us protection money whenever we want it however we want it or else….

Users have the right not to receive Threating smses or emails that are in violation of the ETC ACT. 

As well as the Debit collection act.

They have the right not to allow you to contact them via SMS or email etc. until this law conveniently changes in your favour………. Watch this space.

Since this is a commercial message, and since users have not requested to be placed on your mailing list, this message constitutes an unsolicited communication in terms of section 45 of the Electronic Communications and Transactions Act (Act 25 of 2002).

So on behalf of all users that have received SMESE and or emails please note In terms of section 45(4) of this Act, this message serves as notification that we the road users of SOUTH AFRICA do not wish to receive any communications from you now and in the future unless agreed to in writing with a user’s consent. Failure to comply with this request constitutes a criminal offense in terms of the ECT Act.

The list of laws and rights of the citizens that your company is constantly violating is a very long one.

And just because you found some underhanded ways to get the courts to agree with you that you followed procedure and objections were raised to late doesn’t make what you have done right!

It’s not a real victory. It’s like winning because no one showed up at a soccer match to play you it’s as hollow and false victory as hollow and false as your company and the dictatorship that’s pretending to run our country as a democracy!

Your threats that I will get a criminal record and a blacklisting if I don’t pay you has been received loud a clear.

And all you are telling me by your actions is you either want to make a criminal out of many hard working honest people or you want to create a situation of indebtedness and servitude! 

I personally will not be paying for a system that is questionable that has been implemented underhandedly and that is managed and run by a company of thieves that is trampling on my rights.

By a company that has broken and continues to break laws that I know and some I possibly don’t even know about.

By a company that does not comply with the letter and spirit of the law and by a company that is not open and transparent. You must be so proud to be the schoolyard bully that gets to beat every one with a big stick Wyle a questionable perverted principal cheers you on!

To my fellow road users all I can say is know what your rights are be informed and know what the possible implications of standing by me and fighting for our rights and what that that could entail.

To those that have bought tags under duress I understand that it’s easy to give in when you’re being threatened and intimidated but if you never stand up for your rights you have no right to complain when they are taken away.

There are many ways to protest and make a stand that do not involve “breaking an unjust law” e.g. I’d rather take the option of not driving on the highway in your situation spend a bit more time in traffic and might cost you the same in the long run maybe a bit more but at least you opposed the corruption and underhandedness.
