The Oxford History of the Twentieth Century once wrote this regarding mankind:
"It is useless looking for a perfect world. Not only can it not be found, but the attempt to create it leads to disaster, totalitarianism, and war at its worst.
Does that mean Government the world over is a failure? If so is the rule of law which is fundamentally geared towards Western Democratic Order,a total waist of time?
What is the rule of law and how do Government fit into that picture?
The LexisNexis Group defines "rule of law" as follows:"The Rule of Law, in its most basic form, is the principal that no one is above the law. The rule follows logically from the idea that truth, and therefore law, is based on fundamental principles which can be discovered, but which cannot be created through an act of will.
The most important application of the rule of law is the principle that governmental authority is legitimately exercised only in accordance with written, publicly disclosed laws adopted and enforced in accordance with established procedural steps that are called due process. The principle is intended to be a safeguard against arbitrary governance, whether by a totalitarian leader or by mob rule. Thus, the rule of law is hostile both to dictatorship and to anarchy".
The United Nations under its subheading "Your United Nations" tells us this:
"Promoting the rule of law at the national and international levels are at the heart of the United Nations’ mission. Establishing respect for the rule of law is fundamental to achieving a durable peace in the aftermath of conflict, to the effective protection of human rights, and to sustained economic progress and development.
The principle that everyone – from the individual right up to the State itself – is accountable to laws that are publicly promulgated, equally enforced and independently adjudicated, is a fundamental concept which drives much of the United Nations work.
The principle of the rule of law embedded in the Charter of the United Nation encompasses elements relevant to the conduct of State to State relations.
The main United Nations organs, including the General Assembly and the Security Council, have essential roles in this regard, which are derived from and require action in accordance with the provisions of the Charter."
So it's safe to say that both the UN and the LexisNexis Group(the world's largest electronic database for legal and public-records related information) agrees broadly on what the rule of law and Governments in it encompasses.
In Arab Countries,Islamic law becomes the supremacy of law. In Asian Countries the fundamental principle of moral and philosophical traditions of holding a Government Authority accountable to rule of law and placing the wishes of its populace ahead of its own is core.
In Western Democracies an independent judiciary and the role played by the judicial process characterizes the rule of law. In Continental Europe at large,rule of law centres' on the nature of the individual State, revolving around the role played by the constitution.
Amongst Christians,those whole live by the Bible, find that there are limits to free will.1 Peter 2:16 from the Jerusalem Bible says this: "Behave like free men, and never use your freedom as an excuse for wickedness christians freedom is subject to the rule of law like very other civilized human.
Many diverse understandings of that which is the lifeblood of civilised society,namely the rule of law. With this mind though, has modern Governments and its institutions fare whenit came to:
"the fulfilment in good faith of international obligations; respect for the sovereign equality of States and the principle of non-use or threat of use of force; the need to resolve disputes by peaceful means; respect for and protection of human rights and fundamental freedoms; recognition that protection from genocide, crimes against humanity, ethnic cleansing and war crimes are not only a responsibility owed by a State to its population, but a responsibility of the international community, the equal rights and self-determination of peoples; and the recognition that peace and security, development, human rights, the rule of law and democracy are interlinked and mutually reinforcing."
Sadly the human condition ain't good. More and more people suffer at the hands of someone or something. In the past 150 years or so ,the human family has experienced its worst suffering ever in history.
Millions were wiped out during the Holocaust in Nazi Germany. The International Red Cross estimated that well over 100 million people had been slaughtered in wars at the beginning of the 20th century alone. The Spanish influenza pandemic alone killed among 50 and 100 million people,which was 3% of the world's population of 1.86billion at the time.
Crime and violence are rampant everywhere you go. Drug abuse is epidemic. Sexually transmitted diseases continue to spread. Millions die each year of hunger,malnutrition and diseases.
Family life and moral values have broken down everywhere. Our governments have no answers for these problems. Not one of them has yet overcome the aging process, sickness, and even death.
Too many wasteful government bureaucracies,manipulation and bribing of officials so as to influence, the spending of huge sums of money on useless projects that benefit only a select few , the many assistants they have, the secretaries, the different ministers and departments, along with the red tape that impedes making any progress at all.
Can we truly have a perfect Government that don't tolerate any injustice? Or is it all just s***ty pipe dream? What are politicians really doing behind shifty answers in interviews and cocky smiles at press conferences. Can we trust our governments to make the right decisions for us when it comes to bigger events in real life that we wouldn’t necessarily be able to agree on efficiently ourselves?
Can we trust Governments to our dirty work for us? Are we headed for kind of nirvana or "incarceration" or even our own grave? Which is it? Are Governments just the "vending machine" responsible for spewing of all the troubles we see in our world and it finally becomes then become "undone" when we done?
Where are we headed under today's "modern governments"?Have Government become to powerful for its own good and not that of the people they supposed to look after?
Do you know the answers to these questions? The variety of modern government is to hold control and power at federal level,so may be its time to reinvent innovative governments? Nobody likes the businessman that came out with the text formula that makes you a deal. Many of us are just fed up with governments doing the wrong things and turning their heads the other way.
