No luck for 'sex masseur'

Sydney - An Australian masseur who performed fellatio on two clients should have known the men were not consenting to oral sex despite the fact they didn't complain, a court in Sydney was told on Monday.

Russell Porteus was in court to appeal a four-year sentence he was given last year after being found guilty on two counts of sexual intercourse without consent.

His appeal on the grounds that both men had consented to the intercourse failed, Australia's AAP news agency reported.

Justice Roger Giles said "there was clearly no overt consent" despite the fact the men did not try to stop Porteus.

One man testified at the trial that he thought oral sex was part of the massage.

"I just couldn't do nothing, like, (I) was just in shock," he was quoted as saying.

The second man said he didn't want to protest for fear that Porteus would worsen his shoulder injury.

"I didn't want to put up no fight because I thought this is going to be worse so I just laid there and did nothing," he said. - Sapa-DPA
