'No parole for Derby-Lewis'

Dear Editor,

"You will not go out of prison, Clive Derby-Lewis... you can go to hell. You are not going to go out until you do your time, it's simple as that."

Correctional Services Minister Ngconde Balfour didn't mince his words in replying to the parole application of Chris Hani's killer Derby-Lewis. Was the minister correct in denying Hani's killers the parole? What is the country's official policy on these matters?

This raises the question about the plight of apartheid killers and other hit squad members such as Alfred Nofemela - do they deserve to be paroled? Or should they literally rot in prison? Derby-Lewis is 72 years old and has been imprison for more than 15 years. According to his lawyer Marius Coertze, he is eligible for parole. I hold the view that while his parole is legally acceptable, it is also morally wrong.

An exception would be someone like Eugene de Kock who has fully co-operated with the TRC and has made the total disclosure of his involvement with the apartheid hit squads. Derby-Lewis and Janusz Walus have not been honest right from the start. They have not been remorseful of their deed.

It is quiet clear their aim was not simply to kill Hani, but to plunge this country into darkness. Their devilish act was like a match intended to unleash anarchy and human destruction. It took the personal intervention of former president Nelson Mandela to calm the stormy waters.

Forgiveness does not mean forgetting the evils of the past. It's true our justice system is not driven by revenge, but reconciliation. We should also not forget the pain of the Hani family, who were robbed of their father in his prime. The wounds are still raw!

Granting parole would send the message that his death does not matter and would be an insult to the majority of the people in this country. Forgiveness is not an excuse for blindness to the dangers posed by right wing elements represented by Derby-Lewis. Their ideas of hatred have given rise to right wing groups like the Boeremag.

Hopefully this episode will force the Correctional Service Ministry to draw up special parole guidelines to deal with apartheid killers.

I believe that every murderer and rapist should rot in jail for the rest of there lifes, if you do such crimes you don't deserve to be part of society. I also believe in the death penalty if the prosecution has proofed 100% that you did the crime, why should the hard working man pay to keep the trash alive. Parole is granted after a curtain period spent in jail.. Have a look at crook Yengeni, he was released very early, and stepped into the ANC with big job offer That my friend is a joke. If he is eligible then he is eligible. There are many in jail and paroled for the same crime as the one he committed. Why should the status of the victim play a part. Chris Hani's must never be released, yet if he had killed me it would be OK to be out in 15 years. All killers can rot - but take the selective emotion out of the decision. The minister was embarrassing himself too.

This man Killed another and my believe is that no person should get parole if they are convicted of murder. Look at the Jeppetown killers. They will get parole one day and that is wrong. Bring back the death penilty and only then we will get rid of these killers.

Does the profile/status of who Derby-Lewis murdered make his crime any more or less than the criminal of today who murders a family and gets out on bail/parole/fine?? I have no issues with denying him parole, but agree with your statement that government or the correctional services ministry should have a policy in place to guide them on requirements to be met before parole is given. These days, more often than not criminals released on parole simply return to criminal activity.

You must remeber there were murderers on both sides, and when the 'ANC' murderers hold high office, continue to flout the laws of the country, and freely roam the country with arrogance and disdain, then it takes away much of the moral highground and smacks of moral bias. WHY is the law not equal for EVERYONE?! Tony Yengeni spent a FRACTION of his time in jail, then got early parole. Lewis did his time, but now, everyone is against his release?! Why do we have a law for ANC officials, and another law for everyone else?! Death to murderers and rapists. But, if you are going to release people early from jail, you HAVE to do it to everyone. Unfortunately there are many many murderers who are granted bail everyday, or not caught in the first place. To keep a man in jail to prove that Hani's death has not been forgotten just because Hani is famous from the struggle is not right. All murderers should be locked away for life, whether the victim is black/white/famous/or not. The law must be consistent at all times, all families hurt after a murder, hence all murderers should be locked away like animals and never released.

I feel that all murderers should die for there deeds, but since the ANC decided that they should walk among us, I guess there must be guidelines for release. Many peolpe have been forgiven for their murders and released and re-offended. These people are hardened criminals, at 72 Clive Derby poses very little threat to society he has paid 15 years for his crime. What did Winnie serve for her role in the Stompie murder. I dont want Winnie behind bars but i believe Mr Lewis deserves to be set free.

What makes one murder more or less important than the next person. If I had my way, convicted murderers should be hanged, however, there is no death penaly, so the law must apply the same for all. Why is Hani more special than a child or mother who may have been murdered. Again - people want specail treatment for ANC, and a different law for other. You suck!!

For instance, the cowards who killed innocent people in the St James Church and Magoo's Bar murders are free men - supposedly because their crime was political. They are released on parole after serving 50- 75% of their time and then murder again.They then in court argue that they are part of the previously disadvantaged which gives them a licence to kill. Is the debate here about parole or revenge. If it is parole, then let's talk about this law and not the feelings of the majority . If the ANC is not happy about the parole law , then remove it from the books. They must not use it when it suits them ( Yengeni , et al )and question it when others are to benefit from this law .

Derby-Lewis is no worse and no better than the killers of spouses, the killers of robbery victims and the abusers and killers of children in an attempt to hide their crimes. All the others get parole, why not an old 72 year old man? Political interfence in the Justice sytem? that's what Jacob Zuma was complaining about and went to court about. What's the difference? The old man has served the required time, behaved himself in prison and probably go credits as a model prisoner. Let him go.

The law cannot be appliedf differently depending on who or how important the victim was! I do agree however that the law should be practiced like elsewere in the world, where certain type offenders, in relation to the severity of the crime, can get life - or more - without the possibility of parole.

We need to send out a message to all of South Africa that any one who murders and rapes has no respect for humna life, so does not deserve it themselves. I find it funny that this particular murderer should rot in jail, but what about all the rest who have destroyed peoples lives and taken away their families. What is good for the goose is good for the Gander. We as law abiding SA's expect the government to apply the rules equally to all and political affiliation should not be a guideline. A family member of a farmer being killed or at the Skierlik informal settlement has a much pain as the Hani family. Treat every murderer the same, we do not want them on our streets.

I dont have an opinion on this as I firmly believe in the death penalty. He should not be alive to even have parole. The system is a joke but why, just because it was a racially motivated crime, should he be more harshly punished than the person who rapes and kills an innocent child or children. Why all the hype?? Unfortunately the laws were not written in two seperate books. You can't hold one set of rules and apply a different set when it suites you. Agreed the acts were horrendous, but no less than bombing a church with women and children in it, but that is acceptable because it was a struggle "hit". PS: Mr Balfour has torubles of his own with rather serious irregular "accounting" on his vehciles, hope he's as addiment about serving his time when it comes.......

So his killer should not be treated any worse than any other murderer. I agree that the death penalty should come back, but if you are going to return murderers to society do it consistently. In fact if things were fair and non-racial, Lewis-Derby should have been paroled long ago and have a high ranking government position and a street named after him. Just think how the victims of the "freedom struggle" feel when the murderer of their family members is now a government official and the street they live in is named after the person that tore their lives apart.

Two issues here, the first is should killers be given parole, in my opinion no, they should "rot in hell" as you say. The second is Ngconde Balfour's handling of the situation. "You can go to hell" was unnecessary, it showed to much emotion and way to much hatred. My opinion, Balfour should rot in hell too.

How does one compare corruption with murder?! the distinction in Derby-Lewis's case is that the aim of the murder was to incite violence and possibly provoke a civil war in SA. Remember that Apartheid killings are one thing, but Hani was shot while negotiations for democracy were underway - not in the middle of "hostilities". Derby-Lewis's actions could have denied all of us our democracy.

The article seems a bit one sided, what about the innocent families that get killed simply because they are in the wrong place at the wrong time. Also... the author needs to spell check his work. Let us not forget that Chris Hani was a TERRORIST during Apartheid...responsible for more deaths (not to mention torture) than either either Derby-Lewis or Walus. Actually I think a crime commited for ideals (even if I don't agree with those ideals) does deserve greater leniency than those committed for mere greed. No requirement of reconcilaition or remorse is put on ordinary murderers, so why should those who kill for politics? However, if you want full declaration - what of the ANC murders, for eg. of IFP members? No declaration ever happened there. So can we toss the likes of McBride into the next cell? He's shown he's not fit to be released.

Read up on the event that happened on the 10th April 1993 and you'll realise that your comment is without any substance and totally untrue. Clive Derby Lewis didn't kill Hani "in cold blood, in fron of his little girl" Get the facts dude, this is your history as well as ours.

how about paroling killers that make the Hani killing look like a kindergarten outing? I'm sure the correctional system is paroling people that have inflicted indescribably pain on their victims and families. This indeed a tough one,but if you want to be fair, you should be fair across the entire scope. Why for example are the Jeppestown animals not given life sentences that are NOT being served concurrently?

This case is not comparable under law with that of Tony Yengeni's. In either case the Parole Board could make a recommendation. The appropriate government department makes the final decision. In the case of Derby-Lewis, and I presume this is the same with all murder cases, the matter also had to be put to the family of the murdered party. What is unacceptable is the Minister's emotional outburst. He needs to seperate his job from his personal feelings.

There are references here to people who were in jail for murder and received an amnesty. In the case of Derby Lewis it was ruled that he did not qualify as he could not show that Chris Hani's murder was carried out under the orders of an organisation that saw itself involved in a de facto state of civil war in SA. He and Waluz acted on their own initiative, they were not following orders.

I would agree with you, if it wasn't done so selectively. You know how many mothers have been raped before their child's eyes? They get maybe 5 years in prison. I don't hear you crying about those murderers of the soul.

What makes them more special than the animals that rape, maim and murder thousands of people each year in front of their families. What about the likes of the McBrides that murdered and maimed innocent civilains? The Gov is largely responsible for the shocking rape and murder stats of today. All murderers must be treated the same irrespective of background.

To all those saying he has served his time, he should be released - look up what parole means. He has not served the entirety of his sentence, but because of good behaviour etc, he is eligible for early release (parole). That doesn't mean he WILL be released, just that he might be. Depending on presentations from his side and from those against his release (Hani?s family etc), the parole board decides if he should be released. Mark Chapman, who shot John Lennon in 1980 has been eligible for parole for years, but has not been released yet because of the court representations of Yoko Ono and Lennon?s other family. That said, I think he should remain in jail til he dies, but I felt the same way about Barend Strydom, Robert McBride and Andrew Zondo?
