    Judge Dennis Davis is quoted as saying that 85% of the people want the death penalty back.

    He however mitigates his statement by warning that there should rather be "calls for greater efficiency by police and prosecutors so that their evidence against those accused of murder will stand up in court ... their work is often so sloppy that those accused of income tax fraud stand a greater chance of being found guilty and sentenced than murder suspects".

    Yes, perhaps there is something comforting in knowing that the worst of the worst will face death in the wake of a particularly heinous crime. What proponents of the death penalty fail to take into consideration is that if the state asks for the death penalty to be imposed on a person (presuming that we still had a death penalty), the burden on the state to prove that this is an appropriate sentence is even greater.

    The courts have consistently stated that it is better to free a guilty person, than to incarcerate (or put to death) an innocent person. Therefore, if our police and prosecutors cannot even compile evidence to convict a person (without the added evidence that the appropriate sentence is death), then even if we have the death penalty brought back, it is doubtful whether it will be imposed to the extent that people believe it should.

    No room for error

    Courts will need to be extremely careful to ensure the person's guilt before imposing the death penalty, and it can only adjudicate as to the appropriateness of the sentence if proper evidence is brought before it.

    Again, we are at the mercy of the police and the prosecutors to do their work well and effectively so that the courts can do their work!

    The death penalty is not a magic wand that will fix all our problems - all sectors that play a part in the criminal justice system must act effectively, efficiently and diligently to ensure high conviction of criminals.

    Civil society in turn must also act. Those who feed the criminal networks by purchasing stolen goods, those who assist criminals and all of us who look the other way must also play our part in ensuring that the reasons for criminality is eradicated - and this is done through building family and social networks, of educating ourselves and our children, of building a society based on morality and human values.

    Poverty must be erased and jobs created. In order to do this, we all have a part to play. Next time you are faced with bribing a traffic officer, or paying for a driver's license - stop and ask yourself if you are contributing (even in a little way) to the lawlessness that seems to grip this country.

    The fact is that as much as we can theorise, debate, pontificate and lay blame, the issue is that, by the numbers there is something seriously wrong with our society. The polls can continue but the general consensus is that people must be accountable with their lives for the lives of others. The government should do something for the common man, at the moment they are doing more for the criminal than the law abiding citizen.     You are spot on. The big challenge is if Gov will push with action (not talk)for a more efficient law system where criminals know that the changes of being caught and sentenced are very good. I, however dont see the current Gov ever getting crime sorted. - Palooka

    I hear what the writer is saying, but when proven guilty of murder, rape, surely these people must be removed from society, as they are animals not humans. By going to jail we the tax payer has to foot the bill for their freebee life style. Maybe we should look at the Arab countries, chop the hand off that robs and steals.     Most people don't realise that the act of execution is not the punishment component of the death penalty. If that was so, execution would have been like they do in Iraq, sawing off your neck with a blunt Okapi knife. Instead, a substantial amount of research and elaborate systems aims to make the act as humane as possible. The act is aimed at the permanent removal of an individual from society, of which it was proven that rehabilitation would not be possible. - Hangman

    A life sentence places the burden of the upkeep of the individual on society. The criminal is removed from society because he broke the rules of society. Going to prison removes your civil rights (should include the right to vote too!) Why should society afford priviledges on the individuals that act against it? Hang them high! - Hangman

    I Vote for the death penalty to be brought back! and i agree the will be no room for error. All those *&@#ers that rape 9 month old babies or any women or child for that matter must die and burn in hell, Bring back the death penalty im sure after they make one example those losers will think twice before raping and murdering again - spazman

    The proof that the goverment policies do not work is the fact that innocent victims are raped, robbed and killed everyday. Alife is taken, families are left in devestation and as for the criminal he gets a free vacation to steel city with free bed and breakfast an even a education only to return and murder another innocent victim.     The higher burden of proof for the death penalty is not a reason not to have the death penalty as an OPTION. The death sentence is not MANDATORY. The prosecutor will still have the option of seeking a sentence of incarceration where they feel there is insufficient evidence for the death penalty. Also, dear author, how on earth do you know what "proponents of the death penalty are failing to take into consideration"?     Well put Anya. The death penalty can only work if the police, the prosecution and the judiciary do their jobs. Cops are bribed daily and end up releasing dangerous suspects. Imagine the pressure for bigger bribes if criminals face the death penalty. Even worse is the fact that less than 50% of all crimes committed lead into prosecution. Finally, consider that a criminal will eliminate witnesses in order to preserve their life, something Louis does not seem to understand. Well said, Anya. - Len van Heerden

    I guess its easy for me to talk right now, i've never been put in the situation that i have calledfor the death penalty. as of yet i have never lost a loved one to violent crime so may be i just don't understand the pain, having said that i think the death penalty is a no no, 3 yrs down the line you find out the poor guy was innocent after all, besides u can pay magistrates, prosecutors & police, to loose pieces of vital evidence. crooks don't think they will be caught.     Texas has the most active galores in the USA and yet they execute people every year. Each year, someone does murder someone and each year when caught are sentenced to death. This is public knowledge known by all, yet the deaths still continue at a much faster pace than states where there is no death penalty. So, it is untrue to claim it is a deterrent. Good policing and catching of criminals is a better deterrent. What is the use of having DP when the police are incompetent and useless? - LvH

    My best friend was murdered in Cape Town in February. Fortunately, his murder has not created a blood thirsty vampire in me. I believe the stakes will ven be much higher with the death penalty. The sad thing though is that people believe that their safety is an issue of national policy instead of community awareness. Consider many of the child victims raped and killed were murdered by someone known to their family. How do national policies intervene in that case? Think, Ddb, do the maths. - Len

    Whilst it we can argue about the pro's & cons of the death penalty,it will not change our condition we find ourselves in today.Lets take a look at those societies that abolished it,most of them if not all,are all corrupt with no morals.Compare them with the Islamic countries which we know are way behind their western counterparts.Saudi Arabia has most probably a crime rate of under 1%, whilst others also have a rate of under 3%.If 85% of people want it back then there should really be a debate. - Sham

    I really dont see the point of bringing back the death penalty. Firstly, the death penalty has been shown to have no effect on violent crime in other parts of the world. Secondly, published crime stats show only 5% of criminals are ever prosecuted. If 95% of criminals are getting away with it anyway where is the deterrant in the death penalty?     I agree with Anya [to a certain extent] about the coperative efforts to eradicate crime and avoid the death penalty. However the writer is talking about something that will never materialize. The reality is the punishment doesnt fit the crime in this country. Actually the victims suffer more and longer without support. The death sentence is not revenge, it is a means of removing an individual from society, of which it was proven that rehabilitation would not be possible. By sentencing said individual to life imprisonment, all your are doing is making the society that he preyed on responsible for his upkeep - 3 meals a day, medical assistance, DSTV, you name it.     Read Steven Levitt's Freakonomics. US states with death penalty execute only a tiny percentage of those sentenced to death.     You should not attack the 'death penalty' as a sentence. A rapist or murderer MUST get the death penalty. It is STILL a much more lenient punishment than they gave theire victims. You are attacking our justice system (and rightly so) BUT the death penalty is a suitable punishment in case of 100% guilt. People WANT it back, and they ARE bringing it back themselves by vigilante justice. I fully support vigilanteism as our justice system has collapsed.     True, the law enforcement system is not effective. However, conviction rates and escalation of violent crime is indicative of the fact that stronger, tangible action like the DP is much needed. Those against DP have either not been affected by crime or are naive to the issue. To have an economic and social environment that deters crime will take many years to establish.     It doesnt just help to bring back the death penalty if all the law enforcement agencies have laws which drastically prevent them from fulfilling their mandate as set out in the constitution. Bring back the death penalty, change the laws of the country from protecting the criminal to protecting the law abiding citizens of this country and make sure that all the sick, lame, lazy, corrupt and incompetent people in these agencies are disposed of. - Robert

    This is not a normal country! Everyday I hear of someone brutally killed, this is not a country but meat factory where life is as cheap as government dispensed condom. Islamic law should be introduced for high crime in SA. I was even contacted by an Egyptian citizen who said that they would never visit SA because of the crime - I never said a damn thing about the crime!     what will work even better than the death penalty is if citizens get more rights than criminals, if the law came back that you could shoot someone who is unlawfully on your property whitout having to fear prosecution, criminals will think twice before trying to murder, assault or rob us, but unluckely criminals have more rights than law abiding citizens in this country, hell, they can even vote! wonder who they vote for?(probably ANC) - Anton

    Your logic is seriously flawed. The fact that many murders still occur where the death penalty exists does not prove that the death penalty is not a deterrent. Japan has the death penalty and a very low murder rate. That doesn't prove the death penalty is a deterrent either. Anyway, the deterrent effect is not the only reason for having the death penalty. If the police are corrupt, incompetent and useless then we shouldn't have jail sentences for murder either. - wolf

    The entire consitution needs a relook, NOONE seems to fear the law (seen daily on our roads). I mean you kill a man in YOUR house and YOU are the one that goes to court?     As someone whose life has been touched by violent crime - a murdered relative - I say, "Yes, I still call those who advocate the death penalty idiots!" The death penalty is about revenge, not justice, which is why people say, "Just wait until it happens to you." There is plenty of evidence that the death penalty is unnecessary as there are countries that don't have it and don't have the levels of crime we do.     I don't entirely agree with the writer, if we accept that there needs to be a greater burden of proof, we are essentially excusing poor policing and judiciary...The death penalty must go hand in hand with overall harsher sentences for ALL crimes.     This topic drives home the reasons why we are not ready to bring back the death penalty. The criminal justice system needs to act effectively to ensure high conviction of criminals before we can talk about harsher prison sentences. If I know I have a 1 in 100 chance of actually getting caught if I commit crime and when I do get caught I have a 7% probability of being convicted, how can the death penatly ever deter me from doing the crime? - Justice

    Anya I do not agree with you one bit. The death penalty is a succesfull deterrent in countries with low level of morality. Killing people for cell phones, as is the norm in SA, shows there is no morality. In second place, if I was innocent of a crime and sentenced for a lenghty period, I would rather be hanged than being gang raped in jail every day for the next 25 years. Using your point of view, maybe we should rather also not send criminals to jail just in case they are innocent! - RJ

    The real death penalty problem is WAR. At least people executed under the DP have had the opportunity to defend themselves in a court of law and have been found guilty of a very serious offence. Compare that to civilian war deaths were people suffer horrendous deaths without the opportunity to prove their innocence. Many of these are innocent women and children who just happened to be in the vicinity of some "enemy combatant" that has been targeted from the air on uncontested "intelligence". - wolf

    Surely imposing the DP will serve as incentive for police to collect evidence which "will stand up in court" knowing their work will serve a purpose and that the perpetrators will be punished accordingly rather than being granted bail in a few months. More often than not the barbarians who murder the defenseless elderly and children leave more than enough evidence to arrest and convict them. The rot started 40 odd years ago and the death penalty is not going to change that - a huge shift in values of the people is what is needed, but will not happen until it reaches rock bottom, and that is a few years away yet - take note of the total collapse in Zim. - Erix

    If you kill a criminal in your front yard, you are faced with criminal charges, the law could be on your side depending on the amount you wish to pay off everyone involved in prosecuting you.     Unfortunately I don't have time not to read all the comments. There"s just one "GOD" (He will forgive me) AWFUL TRUTH. The death penalty is carried out in our country every day, I believe 50 times over. Some in the most brutal, primitive, crual, mindless ways possible, by people whom I can only call mindless devils.     The thing is that if we have the death penalty then alot of criminals would think twice before committing any crime. But unfortunately, those at the top sit high in mansions and safe with security without a trouble in the world but we as civilians try our best to keep safe.     I work in Jeddah, Saudi Arabia from an office that overlooks the public square where murderers and rapists regularly quite literally loose their heads. Its very public, very medieval and very gory. There is little or no crime which would seem to sugget that its very effective. Speaking to the South Africans streaming into the kingdom they speak of leaving SA for one reason - crime. Its clearly destroying the country and we need to do something.... - Neil

    But with the way SA people just shoot at each other and kill with hammers and pangas, i think they have full knowledge that they will not suffer for their actions.Death Penalty is a big deterant and will go a long way to prevent people from killing each other.SA Compared with the middle East deaths during the recent Israel-Palestine bombings but there is no war here.Why are people doing that.This government should stop protecting criminals!. - Mark

    Let?s take a moment to examine the words democracy and freedom. Democracy is a system of government where majority rules. Is SA a democracy when the majority of its people calls for the death penalty and the government simply ignores the call ? The government promised us freedom but are we really free if the only way to stay alive is to lock ourselves behind high walls, electric fences and burglar bars ? Are we really free if we are afraid to eat at a restaurant or stop at a garage for fear that one of these murderers who is let out on probation can attack at any time ? In this country, you aren?t even safe in jail at a police station ! The government keeps talking about human rights, perhaps we should sue the government for denying us our right to democracy and for doing nothing to protect our right to freedom ! - Ready to leave this country

    We can all beg for the death penalty to be brought back till we are blue in the face. The fact is for that to happen the constitution must change which means like three quarters of parliament must vote in favour of it. The chances of that happening are zilch! Start pushing for a referendum. Does the DA support the death penalty? - May

    I can't agree with the above article. our justice system is so backlogged as it is, and this is because we have an extremely high number of very jilted criminals who rape, murder and assault at will. The only way to bring this number down is to bring back the death penalty to deter those criminals. A fall in the number of criminals will result in a fall in the backlog. Simple logic. Kill the bastards that kill and rape - I hope they get what they deserve. - Zee

    1. The death penalty might invoke more murders, as the criminal might want to get rid of any witnesses. 2. I think that society should way more than the individual - if someone is wrongfully sentenced to death, it is unfortunate. We cannot free a guilty person because we may make a mistake. 3. The death penalty should be compulsary on all criminals that escaped and are caught again. Them maybe we won't have to use resources catching them twice (or thrice). - Cornea

    Crime is crime. Racism is a crime. Recent revelations in the news suggest that white women are the true beneficiaries of affirmation action. This is racism and it's a crime. How must it be punished. Why must we impose severe penalties for some crimes and let others slide. One rule for all. What's good for the goose should be good for the gander. - Concerned

    bleeding hearts, taxpayer-funded failed-rehabilitation and victims rights aside, the death penalty does kind of guarantee that this person will not kill another, or rape another baby again, not so? Personally I think they should be harvested for organs, then they can contribute something useful to everything they broke... - Anymouse

    If us law abiding citizens stand too loose our life?s due to crime, then so should they(criminals) stand to loose their life. Bring back the death penalty, so they can also live in fear. As far as the extra burden, the police and courts, will know their efforts are being rewarded, and that they will not have to pursue the same criminal in a few months or years again.     Make prison sentences harsher if the death penalty cannot be brought back. Meals consists of a gray goop with just enough calories to get through a day of hard labour. Only a thin matress and a bucket in their icy 6x6 cell. No access given to the red cross or human rights groups and no visitors. No luxuries. Somehow polititians wont buy discounted cars anymore either or mingle with fraudsters. Overcrowding should also seize.. Just a thought - A

    We know the death sentence will never be reinstated. The law enforcement is the actual problem. Sentence serious criminals to "HARD LABOUR" in a facility built by the government (they need to build more anyway) A penetentiary with brick manufacturing capabilties. Bricks to be used by lesser criminals under "house arrest" to build houses for the poor people that were promised houses a decade ago. - David
