    It's become quite clear to me that News24 staff choose which comments are approved and published in the comments section and which aren't. This raises an interesting question many online news providers are grappling with.

    Do you censor the comments or not? I'm intrigued by the options presented.

    If News24 (or any other online news provider) does not censor the content, they run the risk of publishing comments which are to say the least inflammatory and in many cases border on, if they aren't already hate speech.

    In a race-obsessed country like SA with a history of deep racial divisions, this is in my opinion quite irresponsible given especially the amount of users News24 attracts. I do believe in freedom of speech however one would do well to remember that that right is not unlimited nor does that right extend to forcing someone to publish your opinions.

    I can think what I want and almost say what I want as long as I do not libel or slander or deliver hate-speech. Those rights do not however include a right to have my ramblings published and any who think that such selective publishing (censorship) infringes on their rights are welcome to start their own blogs and merrily chatter away.

    Fine line

    If News24 do censor the content(by way of choosing which comments to publish) as they are doing right now, I'm intrigued by the legal ramifications of them publishing what in many cases clearly constitutes hate-speech, slander, libel etc.

    By choosing whether or not they publish the comments, those who submit those comments become by extension "freelance journalists" whose submissions are up to the editor to decide whether his publication carries those comments or not.

    Calling someone a "News24 User" and his contributions "comments" does not change the fact that they have submitted content, and the publisher has reviewed it and then chosen to publish it. So the current comments facility opens up a site to lawsuit.

    As I see it, you have two options to remain on the right side of the law:

    1. If you censor, make sure you get it right. That means no hate-speech, libel etc.
    2. Don't censor at all.

    My suggestion? Clearly indicate at the start of the comments facility that the following content is user-generated and you take no responsibility for it. Provide a link for reporting abuse and only censor comments once abuse is reported.

    This should ensure that if something is reported, appropriate steps are taken and some people's misguided understandings of freedom-of-speech don't lead to trouble.

    News24 puts itself in a very awkward position by sensoring some and allowing others. By being the law on some, does that not imply that they admit the ones they display are acceptable and not hate speech? Sometimes I am surprised that middle of the line comments I submit are not displayed, but direct attacks are sometimes allowed. One wonders if this helps up readership, and thus advertising income. - MJ

    Are we really complicating this too much. I doubt if views are edited except for the typical insults. I have had some of my postings lost, but really am not bothered about it. at the end of the day, the forum allow us to share our views and if someone is offended, they can sue.     that yes news24 do censor the comments made on this forum which is quite childish in a way. If someone wants to provoke me on here or insult my fellow brothers or sisters hell i really dont mind just so long as you dont mind to receive the same and secondly whats the big deal really just let us say what we want to who we want because by censoring our comments you are turning this in to a spaza shop website. - terence

    News24 does put a disclaimer on, stating that the views expressed by users are not necessarily those of News24 and that News24 reserves the right to edit or delete any comments submitted to them. It's not right above the comments section, but it's there. There's no 'report' option, though. Fin24 has it and there the comments do appear immediately and are only removed if someone complains and the complaint is deemed valid. - CTheB

    MyNews24 is a space for only user-generated content to be published. So apart from the odd *Have your Say* article, everything else is written by users, is not paid for, and is in no way solicited or commissioned by MyNews24 first. This means we are entirely dependent on News24 users to write something and send content to us. On the editorial side, we review all content sent in, and reply via e-mail to get the author's confirmation it is their original work etc. We vet content based on writing ability (if its written so badly we don't understand it, we can't edit it ourselves in case we change the meaning of your intellectual property), on volume of content (we won't publish all twenty stories we receive on a certain topic) and based on the tone of the content (and here is the most subjective - we try to imagine how the spectrum of News24 users may interperet a piece. One man's reality is another man's racism!). On the comments side - this is an incredibly time-consuming process. We try to read, edit if necessary and approve or reject all comments as quickly as possible. Sometimes things slip through by accident, but we can then remove a comment once we've been alerted to it. Remember that what you're seeing is simply a fraction of the comments we receive. The vast majority are deemed too racist, offensive, repetetive or antagonistic to publish. We do not, however, feel it is fair to NOT publish someone simply because they have recently been published or because they have commented often. Similarly, we try our best to edit pieces where the author clearly struggles with English, but often those are the pieces we struggle with the most. We would love to publish everything we receive but we simply do not have the resources to spend time editing each and every submission to MyNews24. But please do write for us if you don't like what you're reading. That's the best way to change the content - write what you want to read about. - MyNewsEd

    In approving comments, we try not to edit or remove too many of them, however we do try to maintain certain standards with each article. We rarely if ever edit individual comments for spelling and grammar - with thousands of comments coming in to News24 each month, we just don't have the time - but we do delete comments based on the following basic criteria: 1) The relevance of the comment to the topic 2) The extent to which other users will understand what has been said 3) The extent of swear words, the degree of insulting language and severity of the tone of the comment towards either a group of people or an individual 4) News24 Users who abuse the comments facility by posting under existing aliases or who post simply to incite arguments on the board 5) Duplication of comments - MyNewsEd

    News24 sometimes blurs the line between reporting and personal opinion. Some times they will bill a letter they receive as "top story", or add editorial along the lines of "One of our readers articulates what is wrong with the New South Africa". In doing this News24 are giving unsolicited personal opinions the same weight as their own reportage, and/or presenting a personal opinion as being reflective of national opinion. - Bob Dubery

    I think News24 should censor comments they think are not appropriate.Freedom of expression is not absolute.I've read comments on this site which are hate inspired,insulting & inciteful and wondered why they were published.Some users use hate speech and pretend as if they are from the other race group,like one guy who said that they will rape and kill whites, pretending to be black by using an African name,fortunately his writing style gave him away.We want a robust debate that is mature. - Godfrey

    Everyday I am more and more shocked at how little so-called citizen reporters understand about the media they so brazenly venture into. Like Prometheus above, they don't have the foggiest idea about newsworthiness, laws of defamation, FAIA, the Criminal Procedure Act and numerous other laws, editorial good taste, public interest, fact vs editorialising. I've noticed whenever an article is published on race, they keep the comments open for so much longer and on other issues which they then close them off very quickly.     certainly occurs when censorship takes place. This does not give the opportunity for responses especially when users aim comments directly at other users.     A disclaimer can say that comments do not necessarily represent the site's views, but it also says it supports freedom of speech. If something is published which crosses the lines of free speech to hate speech then what? If they stopping some, should they not stop all 'hate speech'? That is what is being questioned. A disclaimer does NOT blanketly cover someone from legal discourse, especially if through negligence on their part they letting it through. - MJ

    A question, why do we allow News24 users to operate with more than one name/profile. To me this is counter productive in debate, if a user feels strongly about a topic then post it under your name/profile, DON'T hide behind an alias.     the reason they close the other topics off so quickly is because they are so boring and no one is really posting, hence the news24 editors dont have a job hence they will get fired and cannot support their families. Now hate speech and racial articles attract lots of attention and many posts keeping our friends at news24 in the job.     I have become increasingly annoyed with the editors on the mynews site as there is no consistency with regards to censoring the comments - my previous comment to this article was censored (again) for using an example of a previous post which was CLEARLY hate speech and was published, yet several well thought out responses to the offender were deliberatly excluded. Even letters to the editor on the matter (as to why the comment was posted) were ignored/dismissed. Nice to hide behind a disclaimer.. - Sarah

    I believe that what one posts is more important than what their name is. We tend use people's name to determine whether they are black or white and hence whether their views are justified or not. I don't think the users commenting here realise just how bad some of the comments are, how much of it is hate speech and racism and how badly some of it is written.     What I find strange of the MyNews24 site is that almost every week you see that same people being published - with a site of over 1mill local users we can give more people the change to be published on this site. Not a week or two will go by that we will not see Faber, Peter Black, Peter Niel and Kondile and Funnybones have been published twice in less than 7 days. The point is to have an intellectual debate which would be difficult if all you were faced with were rude rantings. It is a derogatory word meaning white scum - as found from the sea surf on beaches - derived from Xhosa when the settlers arrived in the Eastern Cape.     You should not confuse censorship and the exercise of editorial prerogative. The latter is what editors at publications (incuding internet forums) do all the time. If, for example, Juan thinks Kolobe is racist, but Kolobe doesn't think he's racist, and Kolobe things Juan is racist, but Juan doesn't think he's racist, then who is really racist? Your PERCEPTION is that someone is racist, but the REALITY is that they think YOU'RE racist. So yes you could say we're ALL racist, but perhaps, on the other hand, we're clashing with people with a different world view than ours, and we overreact.     Racism, sexism, etc. are not just someone else's perception. Yes, it's possible that it's just a perception or even that it's a manifestation of their own racism. However, racism, etc. are to do with prejudices and preconceptions and are most often identified by unjustifiable generalisations about a group.     There are a number of people who submit on here who have become recognisable. It is up to all who read their comments to be aware that simply because their views are one way (skew or otherwise) does not mean they represent the opinions of everyone we 'think' they represent. It may also only be the oppinionated hot-heads (including myself) who comment, giving an unfair representation of the thoughts of the masses. - MJ

    Are we "really" thinking that people are motivated by getting R500. How shallow do you guys people really are. My articles are my opinions. I could get cricified for them and so be it. But if I happen to get R500, then yeah cool. But if it makes anyone happy, I could easily donate mine to charity. I write because I want to be heard. There is only far that R500 can go these days in our current economy. - Ndumiso

    My challenge is not unfair. If someone takes umbrage that the government is being criticised, Then there must be no reason for crticism. ie everyone must agree. Since everyone very rarely agrees, we have a system like democracy in which every voice must be heard. - mallencolly

    Is the measure used for the protection of any right that might be violated based on the access to information act, in other words you can exercise your right to freedom of speech but if that right violates another person's right then those people rights that'll be violated need to be protected. - Luzuko

    is because most people in this country dont seem to realise the fact that change is good, change is what makes us adapt and learn from the past happenings. there is no such thing as a reversed apartheid! it is a mere interpretation of the situation. the sooner we all embrace one anothers diverse cultures and culminate together to be "SOUTH AFRICANS" the brighter our future will be and the easier it will be to show our fellow narrow minded compatriots what vast potential this country holds! - David (20 yr old SOUTH AFRICAN)
