  • Pretoria - A former state pathologist will face a disciplinary hearing for writing Aids as the cause of death on a woman's death certificate, labour union Solidarity said on Wednesday.

    "The hearing can be a watershed for South Africa in view of the fact Aids cannot at present be entered on a death certificate as the cause of death", the union's Dirk Hermann said.

    Leon Wagner is a former chief pathologist of the Free State who is currently in private practice. His disciplinary hearing will take place in Bloemfontein on Thursday.

    "If he is exonerated and it is found that doctors may in future indicate Aids as the real cause of death on certificates, it would have tremendous consequences for the statistical documentation of this pandemic," Hermann said.

    Currently doctors cannot indicate Aids as the cause of death.

    Hermann said the hearing could have a huge impact on the insurance industry as most insurance companies did not pay out if a client died of Aids.

    If Aids could be entered as the cause of death, South Africa would for the first time be able to measure the extent of mortality related to the disease.

    "We would very much like to see this happening," Hermann said.

    At the preliminary hearings Wagner said he had been told that the case against him was not a legal one, but a "moral issue about which the government is sensitive".

    "I cannot allow the SAHPC (SA Health Professions Council) to compel me to lie on death certificates simply so that government can pretend that the Aids pandemic is an epidemic," Wagner said.

    He believed his hearing could be a turning point for South Africa and that death certificates offered the most accurate data to compile Aids statistics.

    Too many wrongs are tolerated, even enforced by governments, in order to promote a "greater good", ie. lying on death certificates, killing babies and calling it "choice", stealing and calling it "poverty", discrimination and calling it "affirmative action".     We all know that most cases of TB are aids related, so why not just spit it out. Also, I think putting 'AIDS' as a cause of death will have a positive impact on lowering the infection rate. The affected population see TB and Pnemonia on the death certificates if family and friends, so they don't see/understand that AIDS actually caused the death. - Dillon Mantle

    Yes, why not? You die the way you live ... After all the monies that has been spent (wasted?) by the government on educating people on the seriousness of hiv/aids and there are still those who do not take any precautions, then the cause of such a person's passing should be made known to the world. Maybe then others will realise the seriousness of the disease and take the necessary steps to prevent it from happening to them. - lillian van den berg

    Aids is a reality and for as long as there is "no definite cure" our people will continue to die in hundreds!! So why be so secretivie over an issue which has infected and affected us in some way. So yes, lets have it on death certificates for as long as its the cause of death..... - felmon

    How ridiculous. The doctor has to give the cause of death! The WHO have implemented the ICD10 coding system and everytime you visit the doctor the diagnosis has to be coded accordingly! The first problem here is that you have a Minister of Health who has politicised the HPCSA and they are towing the party line of HIV does not cause Aids!! The second issue is that Life Insurers should not and must not be allowed to discriminate against people- even in death! - Chris Morley

    We cannot hide from the fact that Aids and therefore Aids related illnesses exist. It is better for the sake of clarity / democracy to issue a death certificate with the cause of death being "Aids related TB/whatever". We have a right to know how severe the epidemic actually is, and denying its existence is denying our rights as citizens of this country - Shannon

    The government has failed the people of SA and doesn't want to reveal the extent of the AIDS epidemic. In having doctor lie about the causes of death they can hide Manto's failure as minister of health, and the ANC's policy. It's a disgrace, and they should wake up. - Jan

    Why should it be a hidden fact. SA is so big on this subject anyway, but no one wants to admit this on a certificate, but everyone that is someone in this country fights against Aids. Pneumonia can not carry the blame for everything. - Ingrid

    If whoever is ruling on the doctor's actions have a problem with the term "Aids" then perhaps they will permit "Garlic and Beetroot Poisoning - GBP" to be substituted in future. - eddie
