Warder to appeal dagga sentence
07/12/2004 20:35 - (SA)
Cape Town - A petition to Cape Judge-President John Hlophe has secured Malmesbury prison warder Henzil Koordom leave to appeal against a three-year jail sentence for dealing in dagga at the prison.
The Malmesbury magistrate's court released Koordom on R2 000 bail on Monday, pending the outcome of his appeal to be heard in the Cape High Court.
The judge-president was petitioned after the magistrate's court had refused Koordom leave to appeal.
In the petition, defence counsel Michael Petersen said Koordom had forgotten to hand in his spray canister after going off duty on October 5 last year.
He said Koordom returned to the prison to hand in the canister, and noticed an unescorted prisoner in the prison kitchen.
Koordom confronted the prisoner about his presence in the kitchen, and noticed the prisoner had with him a bag containing dagga.
Koordom had seized the dagga, and demanded the prisoner take him to the person who had given it to him.
Petersen said, however, as Koordom accompanied the prisoner, prison authorities arrested Koordom, who had the dagga in his possession.
Koordom was charged with dealing in dagga.
