Court won't drop road-rage case

Cape Town - An application for the acquittal of road-rage accused Shafique Shah on a charge of assault with intent to do grievous bodily harm was refused by Cape Town magistrate's court on Tuesday.
Magistrate Hennie le Roux rejected defence attorney Fagmie Rajap's contention that Shah had no case to meet, and that there was not enough evidence on which the court could find Shah guilty.
The trial arose from an incident in Loop Street, Cape Town, when Patric Vermeer in a car and Shah, on a motor scooter, turned from Strand Street into Loop Street.
Vermeer almost collided with Shah's scooter.
According to Vermeer, the incident angered Shah, who drew up alongside him and kicked at his car.
Both stopped in Loop Street - Vermeer to apologise for his error, but also to tell Shah it was not necessary to kick his car.
'Shah was abusive'
Instead, a confrontation occurred, in which Vermeer alleged he was flung against a car and then on to the street.
Prosecutor Desire Booysen, opposing the application for acquittal, said Shah was abusive towards Vermeer, and that the attack on Vermeer was without provocation.
She contended there was sufficient evidence to prove the attack on Vermeer.
The case was postponed to January 24, when Shah is expected to testify.
