Man's wife, lover in court row

Pietermaritzburg - A woman who was ordered to pay her lover's wife R75 000 in damages, had the order set aside on Monday, saying she had heard the matter had been in court only when The Witness reported it.
In October, Kamintha Gounder of Pietermaritzburg got a High Court judgment against Kamini Greadie - her estranged husband's ex-girlfriend - to pay her damages after she allegedly broke up Gounder's marriage.
The evidence was that Greadie actively pursued Gounder's husband, Anand, even when the couple tried to reconcile and make their marriage work.
On Monday, Greadie managed to have the order rescinded at Pietermaritzburg High Court.
In her affidavit she said Anand actively pursued her, and not the other way around, as Gounder claimed.
Wouldn't give her phone number
She said that when she had an affair with Anand, she had no idea he was married.
She first met Anand in 2001 at the Gentleman's Sports Bar which he owned in Pietermaritzburg. She was married and still is.
She said he asked for her telephone number, but she refused. Months later, he contacted her under the pretence of a business inquiry.
From then on, she alleged, Anand continuously contacted her asking to meet on a personal level - and she eventually agreed.
"Gradually, our relationship began to develop, we became intimate and as a result I fell pregnant and gave birth to my daughter in January 2003," she said.
Greadie added that she discovered that Anand was married and had children only after she fell pregnant.
She said she wanted to terminate the relationship, but Anand insisted that his marriage was over and she decided to give him a second chance.
"It turned out Anand had no intention of terminating his relationship - and when I confronted him, he became physically abusive towards me, to the extent that I was compelled to get a protection order against him," she said.
Greadie said Anand even took her to an attorney with a view to getting a divorce from her husband and he told her friends and family members that, although he was still married, his relationship with his wife was "at an end".
She said there were many other events and circumstances that would show Anand pursued her and she intended calling witnesses to support her claims.
Greadie said she became aware that Gounder wanted to sue her in January this year.
On October 6, Anand phoned her and read the Witness article reporting on the judgment granted against her.
"This was the first knowledge I had of the judgment having been granted against me," she said.
Couple have two children
She then contacted her present attorney to have the judgment rescinded.
Gounder's attorney, Garry Campbell, said his client would proceed with her damages claim.
He said they did not oppose the rescision application and now the case would run its course with Greadie defending the claim.
Gounder married Anand, whom she is in the process of divorcing, in 1999 and they have two children.
