Rath affidavit '13 months late'

Cape Town - An affidavit by Matthias Rath consisting of "2 000 pages of scientific and factual material" in nine lever arch files should be accepted by the Cape High Court, even though it was 13 months late, his advocate argued on Thursday.
The Treatment Action Campaign (TAC) and the SA Medical Association (SAMA) are seeking an interdict against Rath and the government of South Africa represented by the health minister.
Rath's advocate Dumisa Ntsebenza told the court the answering affidavit was delayed because Rath had been awaiting the outcome of a German court case.
However, Judge Burton Fourie said he found this difficult to believe because it had not been mentioned in 13 months of court correspondence between the TAC's lawyer and Rath's legal team.
Ntsebenza said it was "a matter of life and death" for Rath that the affidavit be accepted.
The TAC is asking the court for an order to prevent Rath selling unregistered medicine, conducting unauthorised clinical trials and "making false claims" about multi-vitamins in advertisements.
It also wants the state to be ordered to act against Rath.
