Powell considering civil claim
10/06/2008 09:07 - (SA)
Cape Town - Scorpions investigator Ivor Powell is considering a civil claim, in which he alleges a miscarriage of justice, following his arrest in January on charges of drunken driving, reckless driving and defeating the ends of justice.
Powell stepped from the dock a free man in Cape Town Magistrate's Court on Monday, after his case was struck from the roll, because the Western Cape Directorate for Public Prosecutions had not yet decided whether to prosecute him and, if so, for what.
Outside the courtroom afterwards, reporters asked Powell how he felt about the unexpected development.
He said he was "kind of relieved".
However, the fact that the charges had been withdrawn did not resolve the issues, as much as he would have liked them resolved.
He added: "I do feel this was a miscarriage of justice, and I am taking legal advice about further legal action."
Powell was arrested late at night in January, with fugitive Igshaan Davids in his car with him.
Davids himself is scheduled to appear in the Cape Town Magistrate's Court on June 23, on two charges of car theft.
It was alleged that Powell sped away from the police who had stopped him, to avoid arrest.
