NPA wins appeal in Zuma case

Bloemfontein - The Supreme Court of Appeal on Monday upheld an appeal by the National Director of Public Prosecutions against a high court ruling that halted the prosecution of ANC leader Jacob Zuma.

This means that Zuma, the front-runner for the presidency in the upcoming elections, will still have to face corruption charges.

I'm really not surprised that this result has come about. It's a fair result. The man is forever stating that the law must run it's course, he now has his opportunity to prove his highly doubtful "innocence". to be expected that SCA would rule against Zuma. Judge Nicholson I believe did not overstep his authority. It is a matter of SCA taking sides with NPA i.e. the judgement is made with political inuendos. Ask the SCA "gangs" who is their papa and they will tell you exactly what ANC has been saying all along. The judiciary needs to be revitalised asap! VIVA ANC VIVA! VIVA JZ VIVA! I stand by the NEC decision to ask Mbeki to step down, common sense should prevail!

Nicholson really overstepped the boundaries. This questions his integrity especially given the utterances by some Zuma supporter days before his judgement. Seems like he was bribed or something. Ruling on something that is not before the court is a NO NO. and why the Zuma team didnt see that, is beyond me. but i guess another appeal is on the cards.

Just wondering what his legal team has up their sleeves this time. Any postponement will keep the revenue going. A court case and the outcome thereof, negative or positive, will stop this lucrative source of revenue. They might hope for negative with some appeal options. They might create some trials within a trial to keep the money coming. And...who is paying the bills??

Yes - we need closure, and Zuma must have his day in court. The real problem is the cost of all this and who pays for it. The cost so far has been enormous - all funded by SA tax payers - NOT Zuma. He will fight this, and we will pay again. Zuma must pay his legal costs himself or get legal aid. The tax payer shoudl only pay if Zuma had done his alleged crime on behalf of South Africa.

Now I'm not saying that he is guilty, and I'm not saying that he is not not-guilty but the facts are: One man is serving a corruption sentence for purchasing preferential treatment from Mr Zuma, while Mr Zuma uses your and my taxes to pay defense to keep him out of court. Is this fair? Is it just?

I agree with Justin - if he's innocent, now is his chance to finally prove it. If he's guilty, he can be duly charged. Eitherway its good for South Africa, who (probably) either gets an innocent new president or avoid a criminal to become one. Great stuff.

Judge Nicholson's opinion in 2008 that there was political interference in the decision to prosecute Jacob Zuma was very irresponsible. The ANC swooped on this opinion like vultures to recall President Thabo Mbeki on the basis of this opinion. The ANC was very vocal then. Now Carl Niehaus is calling for restraint from the media. The ANC must stop assessing the judiciary according to how judgements go for or against Jacob Zuma. Assess the judgements for accurate content.

I have NEVER before heard of an innocent man fighting so hard to keep his case out of court. How can such a paragon of virtue who preaches morality and virtue, be accused of having a "genarally corupt" relationship with Schabir Shaik, even though Schaik was found guilty of having such a relationship - poor Mr Zuma must have been completely unaware of this reltionship someone was having with him! The ruling did not come as a suprise to me and it only proved that justice is not as just as it should be and that th ANC were right in saying that the jusice system is manipulated. how do you explain judges contradicting each other?

Justice has taken it course, from here onwards the president of the ANC will now have time to focus on the elections. I am not shaken about the judgement but relieved that this phase is over. AFTER we vote him in as the President of the country that we can look at the judgement, for now we as the ANC are looking forward to the elections. In my opinion the judgement was not clear and the judge only gave brief interpretation of the law and based the judgement on ed cum sections of the constitution
