Bid to shut down Facebook

  • Boston - The owners of a rival social networking website are trying to shut down Facebook.com, charging in a federal lawsuit that Facebook's founder stole their ideas while they were students at Harvard.

    The three founders of ConnectU say Mark Zuckerberg agreed to finish computer code for their site, but repeatedly stalled and eventually created Facebook using their ideas.

    The lawsuit's allegations against Zuckerberg include fraud, copyright infringement and misappropriation of trade secrets. It asks the court to shutter Facebook and give control of the company and its assets to ConnectU's founders.

    Facebook has responded by asking a judge to dismiss the lawsuit. A hearing is scheduled for Wednesday in US District Court in Boston.

    Facebook started in 2004, a few months before ConnectU went online, and now has 31 million users, compared with about 70 000 users for ConnectU, based in Greenwich, Connecticut. Last year, Facebook turned down a one billion dollar buyout offer from Yahoo Inc.

    A spokesperson for Palo Alto, California-based Facebook declined to comment. But in court filings, Facebook's attorneys say ConnectU has no evidence for "broad-brush allegations" against Zuckerberg, and deny he pilfered his ideas for Facebook from his fellow Harvard students.

    "Each of them had different interests and activities," they wrote. "Only one of them had an idea significant enough to build a great company. That one person was Mark Zuckerberg."

    'We weren't going to lie down...'

    Facebook and ConnectU connect college students and others online. Both allow users to post profiles with pictures, biographies and other personal information and create extended networks of people at their schools or jobs or with similar interests.

    ConnectU originally filed suit in 2004, but it was dismissed on a technicality and immediately refiled. The lawsuit claims that in December 2002, ConnectU founders Cameron and Tyler Winklevoss - who are brothers - and Divya Narenda began to develop a social networking site for the Harvard community called Harvard Connection.

    In November 2003, the three asked Zuckerberg to complete software and database work on the site. They repeatedly asked him to finish before they graduated in June 2004, and Zuckerberg assured them he was working hard to complete it, the lawsuit says.

    "Such statements were false and Zuckerberg never intended to provide the code and instead intended to breach his promise ... and intended to steal the idea for the Harvard Connection website, and in fact he did so," the suit alleges.

    Zuckerberg launched Thefacebook.com in February 2004. ConnectU started its website in May of that year. By beating ConnectU to the market, Facebook gained a huge advantage, the lawsuit claims.

    ConnectU's founders have written on their website about the "ups and downs" of their company history, including a programmer "who stole our ideas to create a competing site".

    "But we've been troopers," they wrote. "At first we were devastated and climbed into a bottle of Jack Daniels for a bit, but eventually emerged with a bad headache and renewed optimism. We weren't going to lie down and get walked over like this."

    I wonder if they really think that the 3 months between the launch of the sites makes any difference. I don't think so. If Zuckerberg did take their idea, then he has been much better at implementing the concept. I would wager that ConnectU would have remained relatively obscure irrespective of whether or not there was a Facebook. - llewC

    My my, haven't we all forgotten to stick some sugar in our coffee this morning? Why's everyone so cranky? Bleary-eyed from spending too much time on Facebook? IP theft (Intellectual Property) is real, but yes, three months shouldn't make that much of a difference in the long term. ConnectU is a dof name in any case. It all sounds like typical American ranting, raving and litigation. I think Suckerface should have sold to Yahoo! and retired in the Carribean instead of now sitting in court. - Moto

    There was a site called sixdegrees or something as early as 1999.Google tried something similar, as did myspace, and do not forget tripod,even skype comes into the picture. This is hardly a novel idea.Facebook took off because of it's unique balance between connecting for it's own sake, personal content, privacy settings, ease of registering, ease of uploading photos All this widened the appeal of the whole package.Was it ConnectU's idea to make things easier?Wow,why did I thk of that! - happyface

    It is obvious that Zuckerberg stole their idea, think about it - he worked for them. If they have proof then so well down with Facebook then. Theft is a crime, period. Browse the internet about this and you will see that Zuckerberg even kind off admitted to taking their idea in an interview already! - Down with Facebook

    The article clearly doesn't give a full rundown of what was allegedly stolen. If it was the idea to create a site for social networking of Harvard students, then there may be a case. However, it's difficult to make a leap from that to demanding all of Facebook which has expanded way beyond that. Unless ConnectU is claiming that the plan was to open to the public and not just Harvard, or that code was stolen, or something similar, then no significant IP has been stolen as far as I can see. - C
