Judge rejects abuse motion

Baghdad, Iraq - A military court judge refused on Tuesday to order a new Article 32 investigation into allegations that Staff Sgt Ivan L "Chip" Frederick II abused inmates at Abu Ghraib prison.
Ordering a new Article 32 investigation, the military equivalent of a grand jury probe, would have been tantamount to dropping the charges.
The judge, Col James Pohl, rejected the motion during a pre-trial hearing reset for Tuesday.
Frederick is one of seven soldiers accused in the scandal. He and two others appeared in court on Monday for hearings but the proceeding against Frederick was reset for next month after his civilian lawyer failed to appear.
Later, the military said Frederick decided to ask that the hearing be held on Tuesday, as was his right.
During the Tuesday session, Frederick won the right for his lawyers to question top US generals in connection with the case.
