Judge may dismiss 9/11 case

Alexandria - The US judge hearing the death penalty trial of confessed al-Qaeda conspirator Zacarias Moussaoui retired on Monday to consider dismissing the case over alleged government misconduct.
"In all the years I have been on the bench I have never seen such an egregious violation of the court's rules on coaching witnesses," Judge Leonie Brinkema said in calling a recess in the trial.
Brinkema said she had been advised by the prosecution that an attorney working with federal aviation administration employees due to testify in the case had infringed rules on witnesses.
She said the attorney, who was not identified, had been discussing the case in detail with witnesses who were to be called later in the case.
