ANC attacks not right

The recent attacks on the judiciary by the ANC and its alliance partners not only poses a threat to our democracy, but undermines the rule of law.

South Africa remains a constitutional democracy governed by the rule of law.

Our Constitution might still be in its infancy, but it lays the foundation for open society based on democratic values, social justice and human rights.

The Constitution is the cornerstone of our democracy and defines the role of the judiciary.

Section 165 (2) of the Constitution makes provision for the independence of our courts and requires judges to apply the law impartially and without fear, favour or prejudice. Therefore no one, including politicians or even the president, has a say in the application of law by our courts.

They should not attack judges simply because they disagree with their rulings.

The solution available if a person is not satisfied with a court ruling is to appeal. They must not personally attack the integrity of the judges.

Judges, like other people, should be subjected to constructive criticism, but it must be fair and in good faith
