Since then, Whittaker has cleared the land on his property in Westbrook and has received considerable­ criticism from the Tongaat Civic Association (TCA) who says Whittaker has been “trying­ to take the community for a ride”.

This comes after Prodev Property Group started building on the site despite not having the required approval from the eThekwini Municipality.

The municipality claimed that their law enforcement officer had been denied entry onto the property when they went to conduct a site visit recently.

Municipality spokeswoman Tozi Mthethwa said their officer had tried to serve the summons on Whittaker­, because the stop-work order had once again been breached this week, but had not been allowed on to the property.

She said the municipality had subsequently contacted Whittaker and a meeting would be held this week to confirm the progress of all unauthorised building work.

Mthethwa said if this continued this matter will be forwarded to the municipal legal unit.

Speaking to the Weekly this week, Whittaker confirmed he did not have approved plans and said he was currently in the process of acquiring­ them from the municipality­.

“I have ceased the building and would like to reiterate it was not a formal building, but a sales and marketing site office.

“This is separate from the main building issues. Either way though, we have stopped all construction on the site.

“Regarding the tree planting, I am busy working with municipal officials and we hope to get this out there by the end of June.”

TCA president Jeeva Pillay criticised the entire process saying the developer was attempting to “do whatever he pleased”.

“We want a proper consultation process and we want transparency.

“You cannot erect buildings and industrially earth-move when you have not even spoken to the man down the road who has lived there since his parents were alive.

“The community can rest assured that the civic association will not let this matter just go without ensuring all procedures are followed and everyone is in the loop.”
