THE following are the frequently asked questions (FAQs) that the Department of Agriculture, Forestry and Fisheries normally received regarding the 2015-’16 Fishing Rights Allocation Process (Frap).

What is the function of the Frap 2015-’16 call centre?

To handle all queries related to Frap.

How many fisheries sectors are up for re-allocation and which are those fisheries sectors?

There are 11 fisheries sectors that are due for re-allocation: Abalone, Fishing Processing Establishment, Hake Inshore Trawl, Horse Mackerel, KZN Sardine Beach Seine, Large Pelagic Longline, Netfish, Patagonian Toothfish, Seaweed, West Coast Rock Lobster (nearshore) and West Coast Rock Lobster (offshore).

When and where will distribution and receipting take place?

Distribution of application forms will take place from 23 November 2015 to 11 December 2015.

Receipting of completed application forms will take place from 11 January 2016 to 22 January 2016.

Can I collect, complete and submit the application form on behalf of another person(s) or company(ies)?

Yes, when collecting and submitting the application form, the authorised person must produce an authorisation letter that is dated and signed.

It must be accompanied with a certified copy of ID (individuals) or registration documents (legal entity).

In case of a company or close corporation, the authorisation letter must be signed by the managing director or the managing member.

Where the authorised representative nominated in terms of a resolution, signs the authorisation letter to appoint a representative, a copy of the resolution must be produced.

The authorisation letter must be printed on the company’s or close corporation’s letter head.

The company’s or close corporation’s letter head should reflect the company’s or close corporation’s name and registration number; names of the directors or members; physical address of the company or close corporation and contact details of the company or close corporation.

What do I do with my application form?

Complete the form fully, attach all required documents and submit it at the receipting centres from 11 January 2016 to 22 January 2016.

Will the department provide assistance with completing the application forms?

No, the department will not help applicants to complete the application forms but will only help with explaining the application forms and sector policies.

Can I apply for more than one right?

Yes, for any other commercial fishing sector, provided minimum requirements in that sector are met.

This application process excludes small-scale fisheries.

Will there be an application fee?

Yes, the final application fee per sector has been gazetted and published in a Government Gazette, no. 39417, dated 16 November 2015 and is also available on the departmental website

Is the application fee refundable?

The application fee is not refundable. The non-refundable application fee shall be payable before submission of the completed application form and only proof of payment shall be brought to the receipting centre.

Will there be a grant of right fee?

Yes, the grant of right fee is payable by all successful applicants upon the granting of rights prior to distribution of application forms.

The final grant of the right fee shall be gazetted and published in a Government Gazette.

How will I get the results of rights allocations?

Decision letters will be sent to all applicants and results will also be pu-blished on the departmental website at

Further, general reasons for decisions in a specific fishery will be published informing all applicants on how the decisions were formulated and reached.

The general reasons shall also include an annexure outlining the scores obtained by all applicants in that particular fishery.

Can I appeal the decision?

Yes, an appeal form will be sent to all the applicants with the results.

If my application is unsuccessful, will I be given access to records of other applicants to make a comparison before I appeal the decision?

Yes, the scoresheets for all other applicants in the fishery concerned will be made available on, via each of the fishery control offices along the coast.

PDF versions of the files will be emailed to all applicants who provided the department with email addresses.

Viewing of the Frap 2015-’16 application forms will be provided at Foretrust Building, Martin Hammerschlag Way, Foreshore, Cape Town, during normal working hours. To view the applications, a request can be forwarded to Msimelelo Mdledle or Sive Mpika at or to book a date and time.

Will the decision letters provide adequate reasons in order for me to submit a proper appeal?

Yes, decision letters will contain adequate reasons and the general published reasons will also be attached to each decision letter.

Will the department place a moratorium on section 21 applications? If so, when will be the cut-off date to submit section 21 applications to the department?

Yes, in order to facilitate the orderly allocation of fishing rights, the department has put a moratorium in place on the consideration of the transfer of commercial fishing rights in all fishing sectors that are due for allocation.

The department will not accept any applications in respect of transfer of rights received after Friday, 13 November 2015.

Where can I get the permit application forms once I have been granted a right?

The applications forms for permits are available at the customer service centre and on the departmental website at

Can I fish or operate my fish processing establishment with my right grant letter?

No, successful applicants will have to apply for permits after the right has been allocated.

What criteria will be used to allocate rights?

Applications for fishing rights will be screened in terms of a set of “exclusionary criteria”. All applicants will thereafter be separately scored in terms of a set of weighted “comparative balancing criteria.”

A cut-off will then be determined in order to select the successful applicants.

In which languages will the application forms be available in?

The application forms will be available in the English version only.

Will the application forms be available on the website, and is it possible to email or fax the application form after it has been completed?

The final application forms will be available only on the distribution centres.

No e-mailed or faxed application forms will be accepted.
