Land Claims Court ruling for Muden labour tenants

A RULING has finally been made by the Land Claims Court of South Africa in the long-standing matter between Lot 194 Marina Beach and the Muden respondents, who were declared by the court as being labour tenants in terms of the Land Reform Act.
This matter has been ongoing since 1993 highlighted by marches, protests and general protest by the group at the lack of progress on the part of government and the province.

The court ruling states that the land referred to “shall be awarded to the 1st to 361st respondents” and that the State would acquire the properties “for purposes of providing secure tenure” to the respondents.

The ruling continues that the 362nd respondent (State), in order to acquire the properties as listed by the court, an amount of R36 126 400 has to be paid.

A Trust, consisting of 10 members of the group, is in the process of being registered by the beneficiaries - this must be completed within four months.
Following on the set-up of the Trust, the properties as listed in the court order will be transferred to the Trust against payment in full by the State in terms of the legal entities as set out.
Furthermore, the 362nd respondent “undertakes to take all reasonable steps to expedite transfer­ of the said immovable property.

A spokesman for the beneficiaries said there were still no services provided on the property and it was hoped that municipality would consider the provision of infrastructure as a priority.

The Land Claims Court ruling was made at a sitting in Randburg on 17 November, 2016.
