Two police officers found guilty of murder

TWO SAPS officers from Kranskop police station were convicted of murder by Regional Court Magistrate, Mr Ngobese, in the Greytown Regional Court on 30 May.

Nhlanhla Nxumalo (33) Lindekosi Sabela (35) were found guilty of shooting 28-year-old Thokozani Mchunu on 10 September, 2011.

It was proved by the State that both accused had used their positions as police officers to carry out the killing. Public Prosecutor Mrs Premie Naidoo submitted that on the night in question, acting on information received, both accused had tracked down Mchunu in the Ngome area where he was with his girlfriend.

Using their State-issued firearms, the accused had shot Mchunu four times - Nxumalo with a R5 rifle and Sabela with a 9mm pistol.

It was clear from the evidence that both were off duty on the night in question and had tried to cover themselves by booking in for duty only after the shooting.

They also claimed they had acted in self-defence.

However, the State proved that although the deceased was armed at the time, his firearm was not ready to fire and that no shots had been fired from his firearm.

Prosecutor Naidoo relied on the AVL tracking report of the State vehicle used by the accused at the time, medical evidence, cellphone records and various occurrence book entries to prove the cover-up by both accused and that they had gone to Ngome with the sole intention of killing Mchunu.

The case has been adjourned to 19 July for sentencing. Nxumalo is also standing trial in the Pietermaritzburg High Court on further charges of murder.
