May sentencing for ‘Lazarus’

THE man found guilty of fraud for impersonating a dead Maskandi musician will face sentencing on May 25.

This is after “Lazarus” Sibusiso John Gcabashe’s defence attorney Johan Botha told regional magistrate Rose Mogwera that his client will not admit any of his alleged previous convictions. It means the prosecution will have to prove them before sentencing can take place.

Mogwera postponed the trial once more for this purpose.

Gcabashe, who pretended to be Kwakhe Khulekani Khumalo, known as “Mgqumeni”, stands convicted on five counts including kidnapping, assault, rape, fraud and attempted escape from custody. The first three counts involve the same victim — a young woman who was found to have been kidnapped by Gcabashe in November 2011 and held against her will in the Ixopo and Durban areas. During the ordeal he assaulted her by hitting her in her face with his open hand and raping her on different occasions.

The court found that he also perpetrated fraud on the Khumalo and Mseleku family members in January and February 2012 at Kranskop and Nqutu by claiming he was the late musician “Mgqumeni” while knowing that he was not that person.

On May 4, 2012, he tried to escape from court at Nqutu.
