Husband ‘killer’ to hear of bail

The father of four from Westlake who is accused of stabbing and killing his wife early this year will hear whether he gets bail at the Wynberg Magistrate’s Court next Wednesday.

The accused, Mzuvukile Poni, has been in custody since he was arrested in January on the day his wife was killed.

His attorney argued that it was in the interest of justice that he gets bail in the closing arguments of the formal bail application.

His lawyer was addressing judge Goolam Bowa last Tuesday when the man appeared for closing arguments before the judge had to decide if the accused would get bail.

“There is no evidence that my client is a flight risk. He was arrested at his home and if he was a flight risk he would have run away on the day that he was arrested but no, police found him at his home. He has no previous convictions and no warrants of ­arrest.

“He has been in custody for over four months. He is the sole provider for his children and if he stays in custody he stands to lose even his home. His children are struggling financially and he is no threat to anyone,” his lawyer said.

However, the state maintained that the father of four should not get bail.

“The state has a strong case and he must not get bail. The man is accused of murder.

“The accused stabbed his wife several times. In his re-examination he admitted to this but says he had no intention to kill. His wife was stabbed several times with a knife and scissors which were found on the scene.

“If released on bail he will interfere with the witnesses.

“The accused chased his wife into the neighbour’s house where he entered and managed to lock himself and his wife in a room before stabbing her several times.

“He knows the people involved in this case and if released he might interfere with those witnesses,” said the state prosecutor.

The state prosecutor added that the public outcry and the public petition just went to show that he was not wanted in the Westlake community.

“The community has made it clear that they don’t want him there. If released, there will be disorder in the community.

“The accused says he is thinking and worried about his children, but when he did what he did he knew exactly that he had children. He is worried about the one who has health issues but his mother is still looking after the children.

“The accused has only been employed for three months at his last job so he stands to lose nothing if he is not granted bail.”
