ANCYL donor in court over tax - report

Johannesburg - A Limpopo businessman who made donations to the ANC Youth League has been accused of not complying with tax legislation, the Sunday Independent reported.

Johan Beukes, 44, owns a Polokwane-based construction firm, Mahlehle, which allegedly benefited from government housing contracts.

The newspaper reported that Beukes was being questioned about his donations to the youth league.

His donations were revealed in a judicial inquiry at the North Gauteng High Court in Pretoria on Tuesday and Wednesday.

Beukes declared a gross income of R655 317 for 2010, but in fact earned R1.4m for that year, according to the weekly, which cited court papers.

Sars has accused Beukes of not complying with the Income Tax Act and the Value Added Tax Act.

It also contends that some of his payments may have contravened the Prevention of Organised Crime Act.

Court papers also revealed that there were links between Beukes and expelled youth leader Julius Malema.

Beukes' attorney, Rian van der Walt, confirmed the donations but said donations had also been made to the Democratic Alliance and to the Congress of the People, who were not under scrutiny.

Sars told the newspaper it could not discuss taxpayers' affairs.

    We all know the donations to the ANC Youth League is thank you NOTES for the government housing contracts he benefitted from. And to the journalist who wrote this article, your plagiarism is evident in the different text format. Ctrl+C and Ctrl+V is not always a smart solution.

    Will concede that any form of tax fraud must be investigate DA ANC links included but what concerns me as a South African is that SARS has to ensure taxpayers protection in terms if their private information must be reserved for law enforcement once it hits the papers you know its political and actually a crime on SARS side as releasing such information will lead to criminal charges all I'm saying I'm worried how easy these \leaks\ are it isn't fair and isn't right constitutionally

      That law is used to protect the crooks in SA, people getting government tenders should have their taxes made public. One should not be able to get government tenders and never paid their taxes.

      Once matters are placed on record in court applications and actions then they become public knowledge. They are not leaks by SARS by excerpts of court records which are public documents. So no crime has been committed. Also to clear up another misconception, donations per se are not illegal. They are only illegal if they are made to secure tenders or preferential treatment by those in Government. This gentleman has transgressed the TAX and VAT laws, according to SARS.
