Cases closed in Terre'Blanche trial

Ventersdorp - The State and the defence in the trial of two people accused of killing rightwing leader Eugene Terre'Blanche closed their cases in the High Court sitting in Ventersdorp on Thursday.

Kgomotso Tlouane, for Chris Mahlangu, told the court he had explained to his client the consequences of a decision to dismiss an application by the State to allow evidence about his minor co-accused.

"I consulted with my client and my instructions are to close this case," he said.

Norman Arendse, for the minor, also told the court he had explained the implications of the decision to his client.

"He has elected not to testify. We are also closing the case," he said.

The trial was postponed until Wednesday and Thursday next week.

"The accused will remain in custody," Judge John Horn said.

Evidence inadmissible


Earlier, Judge John Horn ruled inadmissible evidence against the teenager contained in a statement Mahlangu made to the investigating officer.

"I rule that it will not be in the interest of justice to allow the admission made against accused two [the minor accused, who may not be named]," Horn said.

Mahlangu and the teenager are charged with beating Terre'Blanche to death in his farmhouse outside Ventersdorp, in North West, on April 3, 2010.

Both have pleaded not guilty of murder, housebreaking, and robbery with aggravating circumstances.

Mahlangu has claimed he acted in self defence. The teenager has denied involvement in the crime.

Opposing the State's application to admit the incriminating evidence against the youth, Arendse argued that evidence by the investigating officer, Lieutenant Colonel Tsietsi Mano, about Mahlangu's statement was hearsay.

Mano had said that Mahlangu's statement to him on the night of the murder was in his sworn statement.

Testifying on Tuesday, Mano said that according to the statement, Mahlangu and the youth planned the murder and had planned to castrate Terre'Blanche after killing him.

According to Mano, Mahlangu said he went into a storeroom on the farm and found an iron rod.

He and the teenager then entered Terre'Blanche's house through a window. They found Terre'Blanche lying on his back on the bed.

Mahlangu hit Terre'Blanche on the forehead, then twice across the face. The teenager took the rod from him and hit Terre'Blanche on the face and chest, Mano testified.

      That great. If you are under 18 years of age, it is quite permissible according to the courts, to roam the streets with a heavy iron bar, and bludgeon to death anyone you feel should maybe die at that time. In terms of justice, no minor can be charged for his crimes. What terms of justice do the courts work on? Absolutely totally disgusting. I always thought our judiciary still had some creditability.

      AXE???? Uh...if you going to quote the BIBLE.. make sure you actually KNOW it. The verse you are referring to comes from Matthew, verse 26:52 "Those who use the sword will die by the sword". This should not be taken into the context you are portraying! then we might as well say: lets hope these two murderers get beaten to death with an iron rod too, and then the one that kills them must be killed, and so on and so on.... a bit of a flaw in your logic don’t u think Bafana??

    This looks like another Nicholsonic Intervention. ... has the prosecutor placed the accused at the 'scene of the crime' ? ... to declare self-defence ... you must indicate evidence of the threat from which you claim to defend. Soooo... the Judge has to balance two issues of evidential material : ONE : evidence that is available (statement not admitted) to pin the crime. .... --> guilt TWO : vs evidence that is not available (only verbal) of an apparent threat. ....--> innocence Another Nicholsonic intervention ?? ... more drama ... more (racial) division ... more animosity ... more chaos. ...       Nhlanhla, agree some people are still racially inclined wrt to black/white crimes. I (and many other people) am not impressed with the release of 2 of the 4 Waterkloof men - they deserve to stay for their full term in jail. I'm also not impressed by the total incompetence of SAPS to handle a simple crime scene and to prosecute 2 people who admitted to the crime. The fact is that they comitted a murder and should be behind bars - same apply for WKloof 4
