Pretoria - Chances are good that Oscar Pistorius will have to testify in his murder trial, an attorney believes.

Beeld on Monday quoted experienced criminal procedure attorney Marius du Toit as saying that he doesn't believe Pistorius will have a choice.

Pistorius will stand trial next week for the murder of his girlfriend, Reeva Steenkamp, in his Pretoria home on Valentine's Day last year.

Du Toit said it was important for Pistorius to take the stand as he had already admitted shooting Steenkamp, and he needs to explain his actions to the court, especially if there is evidence in which people claim there was a fight on the night of Steenkamp's death.

According to Du Toit, only Pistorius can say exactly what happened that night, and it is up to him to explain that his actions were not illegal.

The State already has prima facie evidence, and if the defence does not offer any other evidence, it will be a proven case.

However, Du Toit predicted that Pistorius's defence lawyers will probably only decide on whether he will testify after the State has presented all its evidence and has closed its case.
