Child rapist’s case postponed 70 times

Johannesburg - A convicted child rapist's case has been postponed in the Nelspruit Magistrate's Court for the 70th time in four years, Beeld newspaper reported on Thursday.

As with his previous court appearances, when Andries Mfana Sibiya, 55, was pushed into court in a wheelchair on Wednesday, he threw himself to the floor and rolled around, eventually coming to a halt in front of the dock.

Sibiya, a lay preacher with his own sect, raped a 13-year-old girl from 1998 to 2007 and fathered three children with her.

He told the court during his trial that God had ordered him to father children so his family could, one day, go to heaven.

He was found guilty on April 2 2008 on nine charges of rape, and had been in custody since then.

During the past four years, sentencing had repeatedly been postponed because of Sibiya's claims of illness.

He had also on several occasions started hunger strikes shortly before his court appearances, and then claimed to be too ill to appear.

The case was postponed to April 4, because a state-employed doctor who was supposed to testify about Sibiya's health, failed to arrive at court.

    ...shocking that the court allows this...!!! If the accused does not pitch up due to any reason after 70 attempts, surely there is a pattern that shows he is showing no effort to proof himself not guilty...! What about video conferencing...?! This guy shouldn’t even get so many chances after being accused of such a crime...!

      If a guy could be sentenced for murder without a body, this guy who has been found guilty too can certainly be sentenced in absentia. His lawyer can explain it all to him on a healthy day.

    Funny how they are perfectly healthy when they commit the crime, but conveniently sick when they have to face the sentence. Pity he was not too sick to rape, and destroy a young girl's life...

    the sentence should be done as soon as possible cos i can see this man is just pretending to be ill because he is the one who is in hunger strike so that he will be weak to attend to his judgement. please ignore his tactics and do the job. this man has just messed the victim's childhood and he still do not show any remorse

    I hope he is kept in a proper jail while he awaits his sentence. Also he cannot apply for parole because he hasn't been sentenced. And then when eventually he gets sentenced after 20 years, the judge sentence him to 15 years in jail and tells him that he could have been out of jail for 5 years already if he was sentenced earlier.
