Cipro: Malema still listed as director

Johannesburg - The Companies and Intellectual Properties Registration Office (Cipro) has not received requests for the resignation of Julius Malema from four of five companies he is associated with, it said on Tuesday.

"According to Cipro's records, Mr Malema is still listed a director on four entities as listed above," its communications director Dr Elsabe Conradie said in response to e-mailed questions on the ANC Youth League president's directorships.

During an interview with Talk Radio 702, Malema insisted that he told his lawyer Tumi Mokwena to remove him as a director of several companies in 2008.

He said Mokwena was going to follow up new information that he was still listed as a director of some of the companies.

There were documents that proved he was no longer an active member of the companies, Malema claimed, but he insisted that he did not have to show them to the media.

Cipro said it had not received requests for his resignation as a director from SGL Engineering Projects, 101 Junjus Trading, Blue Nightingale Trading 61, and as a co-director of Ever Roaring Investments.

His resignation from Ngkape Mining Investments took effect on December 4 2008.

"However, only SGL Engineering Projects has submitted annual returns and will remain in business," said Conradie.


"The other entities are due for deregistration since no annual returns were submitted as required in terms of the Companies Act."

However, Conradie said: "I cannot confirm whether he is still a director or not, as it is possible that he resigned as director, but that neither he nor the company informed Cipro about the resignation."

"It is very unlikely that the resignation is caught up in the system or unattended to. All requests for changes are tracked immediately when they are received."

The decision to appoint or resign directors or members from companies or close corporations respectively remained the responsibility of the entities.

In terms of procedure, Cipro received the application on behalf of the company or close corporation.

All applications were tracked upon receipt for ease of traceability and identification, and they were processed to ensure compliance with applicable provisions.

Authentication was done by generating certificates indicating directors/members, and certificates were dispatched via e-mail or post as specified by the applicant.


When asked for comment on Monday, Mokwena said he had resigned Malema from the companies and would investigate why he was still listed as a director.

He was not immediately available for further clarification.

Newspapers have reported that the companies received government contracts worth over R100m and suggested it was because of his influence in the province.

Malema said he had done nothing wrong and, besides suggesting there was a conspiracy against him, said he believed that people did not want young black businesspeople to succeed.
