Cosatu wants answers on Phakoe's murder

Johannesburg - The Congress of SA Trade Unions (Cosatu) in the North West is resuming its campaign to find out who killed former Rustenburg municipal councillor Moss Phakoe.

"We will make sure that we mobilise community members for fair justice for everyone. Justice cannot [only] be for those who are rich," said Cosatu provincial secretary Solly Phetoe on Thursday.

"If it means we will be killed, some of us, let it be. We are not going to stop the campaign until the people who killed Moss are arrested and prosecuted. The police must face the music."

He was reacting after the North West High Court set aside the conviction and sentences of former Rustenburg Mayor Matthew Wolmarans and former mayoral bodyguard Enoch Matshaba.

Wolmarans was jailed for 20 years and Matshaba was sentenced to life in prison in July 2012.
The two appealed their sentence on the basis of new evidence.

Dossier

Phakoe was shot dead at his home in Rustenburg Noord in March 2009, after he had handed over a dossier detailing corruption in the municipality to high-ranking ANC officials, including secretary general Gwede Mantashe and President Jacob Zuma.

Phakoe also handed the dossier to former co-operative governance minister Sicelo Shiceka, in the presence of Wolmarans.

"We will start our fight again. We will be on the ground and we are serious. If it means we must be killed as it was during that last fight against the police demanding the arrest of those who killed Moss, it will happen again in 2014," said Phetoe.

"Cosatu will be with the family of Moss again. We will now request that the community of Bethanie join us as they will have to know what happened to their son."

He said the court had to tell the family who had killed him and why they sentenced the wrong people.

"The police must account - why did they arrest the wrong people? They must tell the people of the North West who killed Moss."
