Cape Town - The Cape Town Labour Court has dismissed an urgent application by Steven Otter to be reinstated as Western Cape transport MEC Robin Carlisle's spokesperson, it was reported on Tuesday.

The court ruled on Monday that the matter be referred to the Bargaining Council, the Cape Times reported.

Judge Hilary Rabkin-Naicker said it was not necessary for the court to delve into the merits of the dispute, as the council offered an alternative remedy.

Otter was recently transferred to Premier Helen Zille's strategic communications unit.

He applied to the court in June to get his job back, claiming the transfer was illegal and he was discriminated against because he was a vegetarian and teetotaller.

According to the report, the transport department had argued that Otter's communication style with senior officials was confrontational and his dress code "somewhat undesirable".
