Court hears how dead judge was found

Cape Town - Police found the body of acting judge Patrick Maqubela, covered in a sheet in the main bedroom of his luxury apartment, the Western Cape High Court heard on Tuesday.

Security guard Mark Benjamin told the court the judge was lying on the bed.

There was a stench as he unlocked the entrance to the judge's apartment in The Presidents Suites at Bantry Bay in Cape Town, Benjamin said.

He was one of four guards on duty at the complex on Sunday, June 7 2009, when the body was found. He alerted the police.

Benjamin said he obtained permission from the supervisor at the complex to unlock and enter the judge's apartment after learning that the judge's car had been found at the airport.

The State alleges that the judge's widow, Thandi Maqubela, and co-accused Vela Mabena murdered the judge on June 5 2009.
