Drag-racing murder suspect gets bail

2012-03-27 21:39

Johannesburg - A man accused of killing seven people while drag racing was granted R2 000 bail by Tshaulu Periodical Court on Tuesday, Limpopo police said.

Mphedziseni Mawela, 28, faces seven charges of murder, three of attempted murder and one of driving under the influence of alcohol, said Brigadier Hangwani Mulaudzi in a statement.

No bail conditions were imposed on him.

On March 10, Mawela was allegedly illegally drag racing in Tshivhilwi village, Thohoyandou, when his car veered out of control and crashed into a group of pedestrians. Seven people, including two children aged 12 and 13, were killed.

Four others, including Mawela, were injured in the crash.

Mawela was discharged from hospital last Friday and made his first court appearance on Monday.

The matter was postponed to May 29 while police await the results of forensic tests.

Seven dead, three injured (he doesn't count!) and only R2000 bail. Shocking to say the least.

Whilst I understand your anger, I think that your belief about bail is misplaced. I believe bail is designed to take the load off the prisons, with awaiting trial prisoners. The amount of bail is supposed to reflect the level of risk of that person not turning up in court on due date. The amount of bail is no reflection of the type of crime as bail should be denied where violence etc is involved. I am not a lawyer and would appreciate some imput from qualified people, but in the most part, I think I am close to right. Bail also presumes innocence until proven guilty, and be careful what you wish for , should you ever find yourself facing the courts.

SHOCKING! - But according to our magistrate , white people get lighter sentences. BS! If you look at the most recent cases (that have made headlines) its the black guys get literally get away with murder, and the white guys get huge fines (10's of thousands of rands) for spilling a drink, for going 40km over the speed limit etc etc. I think this case just proves the magistrate is racist by virtue of their own inconsistencies

Now they say that blacks get harsher sentences than whites. lmao!

      Luviwe - 2012-03-27 23:58

That is happening in pretoria, others getting out on warning for a serious crime. This one is better a bail of R2000.00 was paid.

Let's do the math. Let me see. 7 divided by 2000. I think that's around 286. Thats R286 per person. Wow the judicial system really went all out here. Is that what's a life worth nowadays. This is ridicules. This dumd speedster should have been denied bail altogether.

Sorry meant to say "DUMB" lol

I refer to my earlier post. There seems to be a lot of misunderstanding around the issue of bail. 1) Bail presumes innocence until proven guilty. Only the courts can try a person 2) Bail is not a sentance, merely a method of ensuring that the accused turns up in court on due date, to face justice. I worry when people act all indignantly around the bail issue, because one day they might be facing the courts, and then the roles will be reversed. You might just be denied bail, or asked for an exhorbitant amount ! All we can hope for is a functional justice system, which applies the law fairly and consistantly..... We have a way to go here !

The problem,HandyAndy, is that people on these forums seem to think that the bail amount is a fine for the offence, or maybe some measure of the perceived severity of the crime. You will have more success herding cats that trying to teach people here...

      HandyAndy - 2012-03-28 12:38

@Pur.... LOL ! The vision of trying to herd cas is very amusing ! I agree, and this issue raises it's head time and time again, and all the angry arguments ensue! I wish some people took the time to enlighten themselves !

handyandy, so if the bail doesnt have to do anything with the case persay, why do other people get R50 000 bail for killing ONE person, and he gets R2 000 for 7. Stop defending

  • monique.fourie1 - 2012-05-03 12:36

this si disgusting, driving under influence, lost control of vehicle, KILLED 7 people (2 children) and he gets R2 000 bail. South Africa, you are SICK and this is probably one of the worst _____ on the case.... what if it was your mom, dad, brother, sister, wife, daughter and son who was killed, will you still give R2 000 bail... NO! Think about the loved ones who lost someone , sis
