Gangster to appeal double life sentence

Mbombela - Convicted Durban gang leader Yegen Naidoo is expected to apply for leave to appeal on Monday after being handed two life sentences for masterminding a hand grenade attack that killed a woman and her granddaughter in Mpumalanga.

Naidoo, 45, is already serving the two life sentences for the murders of Patricia Pillay and her 9-year-old granddaughter, Yetska, who were killed as they slept in Valencia, outside Mbombela, on 23 December 2006.

The National Prosecuting Authority (NPA) has said that Naidoo’s two applications for leave to appeal, to be heard from Monday until Friday in the Mbombela Circuit Court, would be opposed, a Sapa correspondent reported.

NPA spokesperson Medupe Simasiku said: "Firstly, it will be an application to adduce further and new evidence. Secondly, [there will be] an application for leave to appeal.

"The State will be opposing both these applications," he said.

Hired hitmen

Naidoo was sentenced to life imprisonment in the Mbombela Circuit of the North Gauteng High Court in May last year for the two murders.

During the sentencing, Justice Ronel Tolmay said Naidoo planned the attack, as the Pillay family were suspected of harbouring Naidoo’s girlfriend and child who had run away from him. The court heard that the Pillays did not know the woman and child.

Naidoo recruited Mohamed Ismail Khan, 41, and Zamuk Amod Khan, 51, to commit the murders and also supplied the grenade used in the attack.

The two Khans testified that they were acting on Naidoo's instructions when they carried out the grenade attack. Both Khans are already serving life imprisonment sentences and an additional 20 years each.

Naidoo was also found guilty on four other charges and sentenced to seven years for possession of explosives, seven years for conspiracy to commit murder and eight years each for the attempted murder of Patricia's children, Daphne and her brother, Kevin, who were in the house and were injured in the attack.

All the sentences run concurrently.
