Gay judge awaits final ruling

Johannesburg - The Constitutional Court reserved judgment on Tuesday in the case of a High Court judge applying for her same-sex lover to have the benefits of a spouse.

Judge Kathy Satchwell has applied for parts of the Judges' Remuneration and Conditions of Employment Act to be set aside as unconstitutional because they discriminate against couples in same-sex relationships.

The State has not opposed the application. The Constitutional Court heard a brief argument from Satchwell's advocate on a technical point on Tuesday, before Chief Justice Arthur Chaskalson said the court would retire to consider its judgment.

Ndaba says... Some of you are just assuming 'guilty' because its an ANC MP involved. The story as narrated by the victim is not credible. She decided to sleep in the car outside his house. Why? Why not drive home, to a hotel or somewhere safe than sleep in a car outside your usual love nest despite the row? Did she know she was going to be raped? How did she get into the house? Had he gassed her unconscious and carried her inside the house, assuming she asleep in an unlocked car? Anyway a lot of questions leaves the lady vulnerable to lying. I for one have worked with and witnessed so many high profile 'false rape cases.' Such women need to be careful as they let down real victims of rape. The law assumes you are innocent till proved guilty, but the citzenry assumes you are guilty once accused of anything - the doubts never leave their minds despite what the courts say. Lets avoiding racisms and talk 'facts' without this hatred. Read the article...
